I-130 last name yet to change

Hi all,

I am trying to fill out the I-130 and have a question about my wife's last name. We were just married Monday, and so she hasn't had time to change any info (which takes 2 months; time I don't have). Should we proceed and explain to the consulate that her name will be changing? This is Russia and she needs to do it soon. Has anyone else done this? Could she do everything on her old name and then in the USA have everything changed (this will cause problems later where she must stay in Russia 2 months, but that is of no concern now). Please advice.

I love this site. It is the only thing stopping me from having a nervous breakdown.

June 26 2007: I filed the I-130 in Saint Petersburg Russia

July 4 2007: I return to the USA

July 9 2007: I receive a request for additional information

July 11 2007: They receive the information

August 2 2007: I receive a letter from the DHS that the process is complete and sent to the embassy

August 15 2007: Vicky receives packet 3 and 4.

October 2 2007: Vicky gets the visa

DCF is fast and the way to go.

Her name changes when she starts using the new name. The I-130 is a good place to start using it.

I think this depends upon the consulate, but some consulates only require that the passport be in her new name. You give your wife's maiden name on the I-130 form and it will be on the marriage contract. The birth certificate will also be in her maiden name.

If your consolate requires all identification to be in the new name, their will be plenty of time to change IDs while waiting for aproval of your petition for a visa.

I changed my name mid way and labeled the petition this way:

LEGAL LAST NAME (NEW LAST NAME), First name

and they have honored both names for me. They have sent all of my docutments with both names listed.

I'm no expert but I think both the I-130 and the biographic forms ask for other names used... if you list both there souldnt be a problem... right? :)

Timeline estimated adjudication on March 4, 2008. It was adjudicated on April 23.

Our I-130 was approved in 258 days.

10/oct/2007 - I-129F Packet received

12/oct/2007 - NOA1 receipt date

20/oct/2007 - NOA1 received

23/apr/2008 - APPROVED

Timeline estimated adjudication on April 4, 2008. It was adjudicated on April 23.

Our I-129f was approved in 197 days.

08/may/2008 - replied to my e-mail sent on april 30, saying that our petition has been sent to the consulate.

20/JUN/2008 - Interview - APPROVED!!!

18/mar/2009 - Packet delivered

24/mar/2009 - NOA for AOS and EAD date

25/mar/2009 - Check cashed

No there won't be. You should list all names used and clarify which one is your maiden name and previous married name. I am living breathing proof that this works.
