I am not saying the process isn't stressful, but losing ones mind over it is certainly a choice and not a given. Many have survived the process before us, and many will survive it after us. Many are laughing about the complaints that we have about a 4 months delay due to covid, as they have fought for multiple years to be with their loved ones.

 

You are only waiting for your embassy to re-open, and schedule your interview. Count your blessings.

TIES

To get a Visitor's Visa, you need to demonstrate ties to your country of residence.

To get a Spousal Visa,  you need to demonstrate ties to your spouse.

To get Citizenship, you need to demonstrate ties to your new country of citizenship.

But before all that...you need one very important tie..Ties to your own life. This too is very important.

If you cannot live in one country with your spouse, fight for that ability, and if you lose, consider living elsewhere.

But a Romeo and Juliet type of thinking, and killing oneself, is not healthy, mature, or warranted.

Just my view...

 

And yes, spousal visa would be one of the last ones of the family visas to be affected, I would think.

Obviously, by

1) Changing the qualifications FOR the actual approval, and making it the guidelines or the law, in concert with all required legislative bodies.

2) Invalidating a previously approved petition, via the above - revocation of the approval. Legal rules and contracts get revoked all the time...

it is not going to happen, yes he can bring merit base for new petitions, for changing whole immigration system he has to go through congress, 

When two people sign on a contract 

, one of them can’t change according to his choice, both parties has to b agree

But, yes, there is a concept called revocation.

Just to illustrate....if you drive drunk too many times, you can have your driver's license revoked. You can have your visa revoked, your citizenship revoked, your acceptance to a university,  a job offer revoked....people get privileges revoked all the time.

But again, let's not hijack this topic with this basic background on contract law.

There is absolutely no detail in what he plans, if what he plans will ever actually happen, or if it happens, if it will be enforceable.

 

Existing petitions would almost certainly not be impacted, with any part of most petitions being unlikely to be within his power to adjust.

A family-based petition in particular establishes the legal relationship to qualify for applying for a visa.

 

As for visas, the POTUS has a lot more leeway under INA 212(f). His orders must be compliant with existing law, and they must be carried out in a way that does not violate the APA.

The former part of this would be very unlikely to impact family-based immigration alone. The latter part makes implementing any such order (without getting a swift injunction) pretty difficult.

Merit base immigration is nothing new, candan, UK and others have it.  A citizen can only bring spouse and minor children period. No more siblings or parents. The same for legal permanent residents. 

Let just see what Trump will come up with. Since we don't what us in his head, waiting is the order of the day. However,  does he even have the authority to change immigration laws? Hopefully someone will sue his actions

Canadian citizens, permanent residents living in Canada and Registered Indians can sponsor their parents and grandparents, but they are required to provide care and support to sponsored family members once they arrive in Canada.
