visit my spouse and apply for the visa in the US the return?

Hey guys....

I made it through the POE....they gave me a pretty heavy time by keeping asking me questions and checking my whole luggage and stuff like that but I had evidence to proove that I will return to Germany in May etc and finallt I got through. It took me 1 1/2 hours to get through and a CBP was chaising me all the time. But actually they just did their work. In my opinion if you are honest and really dont have a plan in your mind how you can cheat on them they are fine. Despite the fact that some of them give you such pretty mean looks. They also kept asking the same questions over and over again....built failures in it....just to see if I correct them...that was kinda weird actually.

I think if you dont take the risk you will never know....but I also think it depends on the country you are from. Turquish people were pulled over right when they got off the plane...and Philiphines had a pretty hard time too.....dunno why ????! Is there a reason for?

hey Isabel, first off thank you for posting that question. You must have been reading my mind, I had the exact same question As I am or will be in exactly the same position as you are and me and my husband are also planning to start the visa process in the States.

Can you tell me real quick if and which documents you had translated for your visit? - e.g. rental agreement, work contract? Oh and where was your POE? that would help me tons.

I visited my husband last summer under the VWP with my son and we didnt even get asked any questions even though I had taken loads of stuff showing that I had ties to the UK (house lease, school records etc).

That being said though I think you should see if anyone else here on VJ that lives in your home country has had past experience of what it is that you want to do.

That if one doesn't have a planned attack using lies(cheat) that all will be fine. In other words be honest and all will be fine.

First of all...I had all the documents sent to my husband before I would arrive. (I mean the stuff you will need for the visa. For my visit I asked my work and my landlord to give me a confirmation that I am still working....and I still pay my rent and stuff like that. And I also translated a statement from my current account balance.

I would also advise not to bring anything with you what might show to the CBP officer that you intend to apply for the visa. Then you might be denied.

My POE was Detroit and they are pretty taff there....but as long as you dont bring anything with you they can take against you you should be fine. Just be honest....

My husband also did not have too much trouble coming into Detroit a few weeks before we filed the I-130 together. They did go through his stuff and it seems that some items were missing from his luggage but other than a million questions, he didn't have too much trouble.

I entirely agree with meauxna. I don't want to discount what Kezzie as it is possible but this is our experience.

My husband visited many times on the VWP. When asked whom he was visiting, he always said his wife. I think on one visit, the immigration officer stated to him that his visa wasn't correct because he had a US wife. He subsequently asked what visa he should be using if he was working and living in the UK, wasn't living permanently in the US and just visiting his wife. The immigration officer apparently looked a bit trite and stamped his passport.

However, attorneys have indicated that they are surprised he was able to visit so many times on the VWP. I don't want to say that your experience will be the same as ours. It will depend on individual circumstances.

From my little knowledge, but if I try to be logic, that officer did not make a difference between having a USC spouse and intend to immigrate...wich is very different...In that perspective my thoughts are: you can be married with a US citizen and visit him/her...but for any other intend than that, it needs other types of visas: work, study, immigrate....and of course for all the status, the proofs that are required....For ex, as I said in another thread: a canadian nurse was married for 20 yrs with a US gent...living with him..in the US....and refusing to have the US citizenship...so, other than work rights, what else did she have as permission to stay with hubby without being US citizen...and of course that was long time ago...maybe nowdays it's much different (harder) to have this privilege...

It is unlikley that you will be allowed to enter the US on the Visa Waiver Program as you are the wife of a USC and therefore are deemed to have immagrant intent...

you may have to wait until your visa is approved....

I visited my husband on the VWP i was asked a few questions at the desk, answered them honestly,he asked how that worked, me in UK husband in USA,I told him i was going through the immigration process, he asked did i have any paper work to show that i was, and i had taken my NOA1 with me, i showed him that and he said............"your good to go, have a great visit".............. :yes:

We did both K3 & CR1 visa's, got both!!- I returned to England for my CR1 interview after first arriving on a K3 visa!!

May/25th 2006- Green card arrives in the mail................YAY!!

19th June 2006 I Had to go to the Social Security Office to get my number, the DS-230 didnt work for me!!

26-June-2006- Social Security# arrived in the mail....YAY!!

Feb 2008 lift conditions <<<reminder to self!!<<<< went to England for a visit instead, no rush right, 90 days is a long time,LOL

Removing Conditions Begins

Mailed I-751 April 12th 2008

signed for @ NSC April 16th

NOA date April 16th

Conditional GC expired May 5th 2008

Biometrics Detroit May 10th 2008

10 year Green card ordered August 20th 2008
