Can I extend the entry date on my Mother's Visa?

My mother still has unfinished business in Vietnam but the 5 month period for her to travel to the US is ending soon. Is it possible to extend or delay the date?

No. Once the visa expires, she’ll need a new medical and the embassy will have to issue a new visa. Per the current bans, IR5 visas are suspended until at least end of the year, so she would not get a new visa anytime soon. She should travel to the US now, and once she has her Greencard in hand she can return to tie all lose ends.

 

This is assuming that your mother is intending to immigrate via IR5 visa. Any other scenario might result in a different response.

Option 1 (very highly preferred): Get to the US before visa expiration. If taking care of things back in Vietnam is going to take <=6 months, she should be able to just come back without issue. Up to a year abroad is a bit riskier without having spent time in the US to really establish ties, but may be fine. A re-entry permit would not be a bad idea IMO. Over 1 year, definitely get a re-entry permit.

 

Option 2 (not suggested): Let the visa expire then contact the consulate to reissue a new one. A new visa fee + medical would be needed, plus any updated documents that may have expired. Keep in mind that new IR-5 visas are banned until at the very least 2021, too.

 

The choice seems pretty clear to me...

Why delay ? Korean Air still operating the route from  Saigon-Incheon-USA. She can book a round trip and come back to VN on the next day with the I-511 stamp on her passport. With the current ban, there is no new visa for her at least by the end of the year.

This is actually detailed on the website of the US embassy in Vietnam - bolded & underlined the bit relevant to your mom. If she doesn’t come now she may have a very long wait, because who knows if trump will extend the ban again at the end of the year (no matter what happens in the election he will still be president then)

Why would you want her to jeopardize her visa? Get her here as soon as possible. Once that visa expires, she will be subject to the proclamation.
