Hello guys,

My name is Sandeep [REDACTED] and my husbands name is Sahib [REDACTED] , I am planning to file for his green card applications but we have an impediment on our hands. Need some help:

My husband came to the United States as an F-1 student and now has OPT and I am a natural born citizen. We got married at the County Clerk’s office last month. We are wanting to start his green card process. We are trying to gather our pre-requisite documents but have encountered a problem on our marriage certificate.

 

1.A First name: Sandeep

1.B Middle Name: [REDACTED]

1.C Current Last name: [REDACTED] but I changed my last name in section:

 30. A First name: Sandeep

30.B Middle Name: [REDACTED]

30.C Last Name: [REDACTED]

My husband kept his name as is.

 

I have this new name on the marriage certificate as New Name though I haven’t used this name elsewhere. 

Can I use my old name (from section 1.A - 1.C) on his green card application or do I need to use new name (from section 30.A - 30.C) 

If I use the new name, I will have to change my name legally everywhere. SSN, DMV, Passport, Bank Accounts, Car Insurance, Health Insurance etc.

 

Can any one help us understand what needs to be done

When I filed I used the name that I have always used although my marriage certificate states I will be changing it. I haven't been approved yet so I dont know if it will be an issue or not, but at the moment of form submission use your name as it is now. After you change it on all other identifications then submit your name change to USCIS.

In the form I-130 it does give you the option to mention any other name you have used. You can specify your maiden name over there.

The immigration lawyer i worked with told me its not an issue since usually the marriage certificate (issued in California in my case) do have both the names of the person (before and after marriage). You should be fine since you are the petitioner and not the beneficiary so he must make sure his documents are correct.
