Hi everyone I sent my i751 Joint petition on January.i got married in Miami 2016 moved to Atlanta 2017 end and adjusted the conditional status here I got charged with DUI ,reckless driving, open container on 2018 December case is still pending in court another. Another issue is I had argument with my wife and our relationship is not going good and I don’t think it can last longer I m tried to save this relationship but it’s getting worst now I just got update for RFE also wich I dint received letter in mail I called us is and asked for another copy. I spoked with attorney they say to file divorce and let them send the further documents wich they are asking 3000$ .if anyone suggest anything on this it will be helpful
documents wich I submitted .

2 years house lease with utilities bill both names

3 years joint tax returns 

I have a bank checkin ac from 4 years with transactions 

renters insurance 

phone bill with both numbers 

3 affidavit from friends

5 photos 

and my DUI charges with other traffic tickets and arrest report.

that’s all I have any suggestions will be appreciated........

What specifically did your RFE ask for? That is where you need to start.

Does your wife know your are going to file for divorce? One fight doesn’t seem to justify a divorce but it’s not my life... You can file with a divorce waiver if you choose that route. As far as your legal issues those are more concerning and I will let others address them.

Thanks for replying.The RFE I haven’t received yet It’s not just one fight we r have  argument every other day  she is not happy with me As we both are from different  culture I want to see her happy we got married after dating more than a year where she was my colleague worked for same company .that’s why we are thinking to take this step . Apart of this legal issue I have completed all requirements as per my DUI attorney said just waiting for court date to finish this case .

From the I-751 instructions:

 

Criminal History If you have ever been arrested or detained by any law enforcement officer for any reason, either in the United States or abroad, and no charges were filed, submit an original official statement by the arresting agency or applicable court order confirming that no charges were filed. If you have ever been arrested or detained by any law enforcement officer for any reason, either in the United States or abroad, and charges were filed, or if charges were filed against you without an arrest, submit an original or court-certified copy of the complete arrest record and/or disposition for each incident (for example, dismissal order, conviction record, or acquittal order). If you have ever been convicted or placed in an alternative sentencing program or rehabilitative program (such as a drug treatment or community service program), submit: 1. An original or court-certified copy of your sentencing record for each incident, and evidence that you completed your sentence, specifically; Form I-751 Instructions 12/02/19 Page 7 of 10 A. An original or certified copy of your probation or parole record; or B. Evidence that you completed an alternative sentencing program, or rehabilitative program; 2. An original or court-certified copy of the court order vacating, setting aside, sealing, expunging, or otherwise removing the arrest or conviction; or 3. If no record is available, an original statement from the court that no record exists of your arrest or conviction. NOTE: Unless a traffic incident was alcohol or drug related, you do not need to submit documentation for traffic fines and incidents that did not involve an actual arrest if the only penalty was a fine of less than $500 and/or points on your driver’s license.

 

If you sent all of the above with your I-751, the RFE is most likely for other reasons, just wait and see what it specifically asks you to send.

 

Is the $3,000 the attorney quoted you for the divorce?  Or to respond to the RFE?  $3K sounds typical for a divorce, if that's what you want to do start that process to end the marriage.  If not, spend the money on a good marriage counselor and go together to try and save your relationship.

 

You should be able to respond to the RFE and complete the ROC process on your own without spending $3,000 for an attorney's secretary to send in the forms for you.  The only time attorneys are worth their fees is when there are unusual complications like a waiver.

Thanks a lot for sharing this information it gives me moral support My DUI case is still pending and I have submitted all records related to that but since I dint got  hearing in court I don’t have further documentation. Thanks again 🙏🏽.

Fire the law firm. they are advising you based on more $$ for their bills.  Figure out what the RFE is for  ? no one can tell what they are asking for ?

Whatever the OP was asking, he was asking it on a public forum, where anyone can answer, and talking about an emotive topic, that many people have strong opinions on. 

 

If I came on and said "I got caught doing a bit of raping in 2019, what forms should I include when sending xxx application?"...I imagine that that I'd get some opinion/emotion-based comments as well as informative ones...and my crime would certainly warrant it.

Public form is not a place where anyone can through any garbage without knowing the depth.strong opinion about a person can only created by knowledges of circumstances and apart of this form this is created to get suggestions in a tough situation

Suggestion is pay the attorney a lot of money, hopefully the loss of which will spur you to change your reckless behavior.

Just another random guy from the internet with an opinion, although usually backed by data!

I have to second @JFH you need to seek help and I would not want to deal with alcoholic as well if I was your wife.  I see there is always reason for an alcoholic to think it is ok to drink. 

My nephew is disable mentally and physically ( can't feel from neck to toe ) because a " cool guy" decided to drive with over 2.0 alcohol in blood because he had the need to overcome his sadness with alcohol and driving and hit my cousin's car after picked up his son from music class. Yes they got insurance money but no it does not worth the suffer my family went through. 

 

DUI and still try to defend your self. Sad to read it.
