Yup, no way they were an LPR before the date of the interview. The card has a mistake and needs to be corrected.

Do they? It's not in their timeline and their signature only mentions a month....like in anticipation of filing.

If not filed yet and the date of I-485 approval is confirmed (both their timeline and signature imply the card is wrong), then I would hold off on ROC until the proper time to file.

Ah. Another drawback of the mobile version of VJ is that I can't immediately see the signature section.

 

I was basing it on the profile area saying "Filed: Lift. Cond. (pnd)"

I-751 has been sent off in the mail and we are waiting for receipt notice. An attorney told us that sometimes they 'credit an extra year' if they were legally physically present in the US and were included on taxes because the IRS?

Don't listen to this attorney.  There's nothing in the law that allows crediting an extra year.  

 

A mistake was made on your husband's green card and it should be corrected.  

 

No one can be an LPR on 9/14/2018 when their I-485 wasn't even received until 9/21/2018.  An impossibility.

That attorney either has no clue what they're talking about or was just blowing it off. There is zero discretion on when LPR status begins...it's all dictated by law and regulations. The IRS has nothing to do with anything here.

There is a case where one year can be retroactive counted as being admitted as an LPR, but that involves unusual circumstances like asylum-based AOS. It does not apply to family-based immigration.

 

Sounds like the card was printed with the wrong date.

If that’s the case most h1b to green card adjusters would be eligible for citizenship as soon as they got their green cards!

No, that doesn’t sound right at all. It’s not the first time we’ve seen errors on green cards. The hindsight wisdom is always to query it with uscis at the time you receive it.

How much does the lockbox actually check before sending a receipt notice? In other words would they just accept the date on the form plus correct check as valid  on the face of it, or would they do checks on i485 approval date?

Somewhere between 0% and 100%. I've seen it be hit or miss....sometimes being caught and sometimes being accepted and then going through the entire ROC process to learn of the mistake (being denied and having to refile).

In at least 1 case I've seen it make it through ROC successfully, but then was caught during naturalization.

Zero.  On its face, the copy of the green card is presumed correct and so it the paperwork, so the lockbox employee will put it in the queue.  Only when the case is reviewed will it be possible for USCIS to uncover the date mistake.

Well, I am glad that I posted about it! To think, if we hadn't asked we might be fully expecting an acceptance and removal of conditions.
