I had an emergency interview but...

Timeline

I had an emergency interview on July 14. I got 221g for "Administrative processing plus passport".

The officer told me they can't process K visas. I was really nervous and confused at the time, so I confirmed with the officer "I passed but you can't process my visa?" 

She said yes, gave me my passport back and told me to wait, that when they start processing they will let me know so I can send my passport through mail or I can contact the consulate with my case number.

Now I'm confused because I have seen people get their visas in Manilla and Sydney in the past month. 

Why would they grant me an interview but not process my visa? 

 

I don't understand the AP well so it would be great if anyone could shed some light.

Did the 221g state any missing doc? 

Did you hear any feedback from them yet about your visa?

 

"Refusal under section 221(g) means that essential information is missing from an application or that an application requires additional administrative processing. The consular officer who interviews you will tell you at the end of your interview if your case is being refused under 221(g). The consular officer will either tell you that the case has to undergo administrative processing, or will ask you to submit additional information."

No, I had all the documents.  They just said they can't. On a follow up email we sent they said 

"We regret that we are unable process any fiance visas applications as of this date."

 

My best best is that they did not take my emergency seriously.

Sorry to hear that. The embassy website states the following and K1 visa is indeed not being processed at the moment. Wonder why they even scheduled the emergency interview if they know they would not process it...Did you or your fiancée try to contact congressman or senator for help?

 

"UPDATE: As of June 22, 2020, most immigrant visa categories (with the exception of IR-1, IR-2, CR-1, and CR-2), as well as the nonimmigrant visa categories H-1B, H-2B, L, and several J visa categories (au pair, intern, trainee, teacher, camp counselor, and summer work travel), are suspended through December 31, 2020. "

That proclamation doesn't apply to K1 visas.

 

Thanks, it's very frustrating.

I don't know if reaching out to them would help? we were so devastated with the news that we just don't want anything bad to happen now...

Even though it doesn't apply to K1, it doesn't exempt K1 from proclamation as other "mission critical" visas such as spousal visa.

 

Also with the closure of embassies, they haven't resumed routine visa services.

 

It sucks...trust me I know! I'm waiting for the visa with the passport waiting at the embassy.

it does have to do it with the suspension of routine visas services as K1 is not mission critical but it has nothing to do with the proclamation.

Yes you are right, but embassies are quoting that proclamation as a reason for not processing at this moment.

 

I have applied for emergency processing of my K1 as ours is at the last stage just waiting for visa.

 

And they told me they can't process it because K1 is not covered by the list of cases determined to be mission critical from this proclamation.
