Does the beneficiary have to provide tax transcripts?

Here I am with yet another question but I cannot seem to find an answer to this question.

 

Do I as the beneficiary have to provide my tax transcripts? I had to paper file so my return will likely not be processed for a pretty long time and we would like to get going with everything soon.

AOS

08/25/2020 - Sent I-130, I-485, I-131 and I-765 to Chicago Lockbox using USPS                                         11/06/2020 - Received physical receipt notice for I-765 in the mail

08/28/2020 - Package was received by USCIS                                                                                                   12/15/2020 - Online account updated and indicated the I-944 RFIE was sent

09/25/2020 - Debit Card was charged by USCIS                                                                                                 12/28/2020 - Recieved the I-944 RFIE via e-mail after speaking with a tier 2 officer

09/29/2020 - Recieved text notifications from USCIS with reciept numbers                                                  1/11/2021 - Responded to the RFIE and sent the I-944 to USCIS 

10/01/2020 - Recieved rejected I-765 back                                                                                                           3/3/2021 - Biometrics scheduled for 03/29

10/05/2020 - Recieved physical reciept notices in the mail

10/06/2020 - Sent I-765 to Chicago Lockbox using UPS

10/09/2020 - Package was recieved by USCIS

10/30/2020 - Recieved text notication from USCIS with reciept number for I-765

For adjustment of status,  there is no such thing as a beneficiary.   The alien is the applicant.   The only ones required to provide tax transcripts are those who are sponsoring the applicant.

For AOS, the applicant (beneficiary/alien) needs to provide tax documents with i944 for any income earnt in or outside of the US during the most recent tax year

Incorrect.. page 5 i944 instructions... You and Household Members must provide tax transcripts

If the information isn’t available, put in the figures you believe to be correct and write a statement saying it’s been delayed for whatever the reason is and that you’ll provide at time of interview..

Okay, I will probably do something of that sort.  I have my W-2 from last year so I could include that and a copy of the paper return until I recieve my tax return and can get the transcript.

Do you happen to know whether it will look bad if it was below the 125% on these transcripts? Both me and my husband were students last year so we did not make enough money (he does now as he works full-time which will be used for the affidavit of support).

The sponsor needs to earn 125%, if he cant show this on his last return, but has since started working or increased his income etc he can demonstrate 125% now using pay stubs and letter from employer (6 months worth I think).. additionally, it would be worth while him seeking a joint sponsor

He makes a lot more than the 125% minimum currently and we can provide them with rougly two months worth of paystubs by the time we send in our application as well as a letter from his employer so we should be good on that part.

 

For the self sufficiency document, however, they only ask for tax transcripts where this is obviously not reflected so I guess my question was whether or not that would be a problem in terms of getting denied. I have read more on it though and I suppose since we were both students (and being a student is considered a positive factor), I should not be too concerned about it as of now.

Well, for self sufficiency, in addition to his income, most people would include any savings, liquidable assets, retirement funds etc owned by either he or you.  normally this would include the value of things You could sell back in your home country eg home if you had one, car, sellable furniture, or cashable retirement fund, or trust fund..

 

education counts for self sufficency too, especially if it’s in a higher degree range through university, your employment history and history of earnings counts in this section too.. remember uni debts are a negative.

I am sure that we will be fine, we have a lot that will be favorable as well (great credit score, english proficiency, health insurance etc) but it is difficult to not overthink everything. Maybe speaking to a lawyer would be a good idea as well.
