Hey all I just wanted to ask and see what would be best to do in this situation. 

I'm asking as I have ran into an emergency and we are planning a request. I am just doing some due diligence now to know where I stand with the border. 

 

I have read a couple times on here now that individuals have phoned the CBA and have been told K1's are now considered essential and are able to cross the land border. 

 

I emailed the CBA 2 weeks ago and got a response and the office said no K1's are not considered essential. However they did suggest I phone the post I plan on using.

 

Is this just a CBA post by post thing or?

If on the Phone, I've read the site is harder to use. It's all good though we can move it when it happens. I thought the Covid forum might get you better results for this question.

What are you trying to do? Entering the US with a valid K-1 visa and then get married within 90 days to file for AOS?

As of today flying to the USA from Canada does not pose a problem. Non-essential travel to the USA/Canada via land is not permitted until July 22 the earliest. 

 

Immigration does not fall under non-essential travel.

 

“Non-essential” travel includes travel that is considered tourism or recreational in nature.https://www.dhs.gov/news/2020/03/20/joint-statement-us-canada-joint-initiative-temporary-restriction-travelers-crossing

We are applying for an expedited interview given some events that have occurred. I am just inquiring about the land border so if we happen to get an approved request I know how to plan accordingly.

 

So essentially yes, if the expedited request is approved and I am able to have an interview to hold a valid Visa I will be moving marry, and then AOS.

I am aware that flying is still good. It was the land border I was a bit curious about since Ive seen some posts saying people have called the particular port and said they could cross. 

I'll keep an eye out though thank you!

Non-essential travel is suspended until currently July 21st - according to the wording this is for visits (tourism, leisure, recreational trips) so I would assume that a move does not fall under this https://www.dhs.gov/news/2020/06/16/fact-sheet-dhs-measures-border-limit-further-spread-coronavirus

 

The bigger hurdle is probably the expedite approval - once you have the visa in hand, you can contact the different CBP posts that are in reach for you and ask them. I would clearly state that this is a permanent move and not a visit. A friend of mine was recently allowed into Canada to be with their partner (not married, one household in the US and one in CA) after getting in touch with the Canadian border control.

Hi! I crossed the land border with the K1 visa on July 1st. No problem at all to cross at the Champlain, NY POE. The processing of the visa and importing my car took about an hour. Hope this helps.

Its my last resort as I the airlines won't allow my dog to be flown because of her breed 🤦‍♀️ but if I found someway of getting her there that didn't cost me a fortune by land and could fly I might be open to it. I also have a car I need to bring so its all just hoping for the best in a fluid situation as you said 😂
