Qualifying with assets

My husband and I live in community property state, when filling out the I-864 would I split the total cash assets (joint savings and bank account)

and the value of our home 50/50 and populate that into our totals?

 

If I am counting the rental income we get from that property can I claim the whole total or would that. also need to be split in half?

 

Appreciate your help!

That is correct.  In addition, "rental income" is not income until it appears on the "total income" line of a tax return.  Before that, it is only revenue, not income.  Business/Rental income is revenue minus expenses, depreciation etc.

 

Liquid assets need to be a minimum of 3 times the income shortfall to meet minimum requirements.

thank you.  so say we have 70K in a joint bank account - is that all my assets?  where do we put his from that joint account.  Same questions for the property is the value after the appraisal minus the mortgage due, still all my assets and he has $0 from that?

You are posting in a visa forum, so I will assume your husband is not in the USA.  As such, assets in the USA are YOURS, for purposes of the affidavit of support.  That your State is a Community Property State, is irrelevant in this context.

yes, thats correct :) he is not in US.  If he is on the deed is this also the same?

Yes, that it is a community property state is irrelevant in this context.  However, the full amount of joint assets are available to him if/when he completes the DS5540, in my opinion.
