Would Merit Based Immigration Affect Spouses?

No reason to be appalled.  Typically there has been no discussion regarding any changes to visas for spouses and children.

BTW:  Canada, Australia, and New Zealand have merit based immigration systems.......

Everyone freaking out about an EO that changes from morning to evening and from PBS to CNN to Fox news. If you even believe that 10 percent what he says is true than you need to chill

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

No change Trump has suggested in the past, changed anything about spouse or stepchildren immigration except a perceived tightening of financial sponsorship criteria.  I can't imagine a failure to carve out immediate families of US Citizens.

Facts are cheap...knowing how to use them is precious...

Do you have any idea about the potential change to financial sponsorship criteria? I don’t have an extensive work history and limited income. I’ll be able to meet the 125% of the poverty level, but not much more. And that concerns me. I read that if you’re living with a parent, you’re allowed to include their income if they permit you to do so. Will options like that still be allowed?

No options have been taken off the table.  Information about those options can be found in the I-864 instructions.  Become an A-Student of those instructions.

I can see sibling immigration being abolished before K-1s are scrapped. 
 

I did read an interesting article, which I can’t find now, that presented a good case for scrapping the fiancé visa process and having a spousal visa process only. Mainly to cut the workload for USCIS with AOS applications and to cut claims of false or frivolous VAWA claims as the immigrants will automatically be permanent residents so there will be no need to find “creative” ways to stay if the relationship falls apart before the green card is approved or if the sponsor withdraws the I-864.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

I was reading articles on Trump's past ideas for "merit based" immigration. This one was from May 2019 and they said (on the last line) that Trump has always left immediate family based stuff alone. So if he's sticking to what he's always done then He is just reforming work related visas and other visas and is leaving the spousal stuff alone. Hopefully this is the case, for sure we will have to wait and see, but it gives us a good idea of what his main concern is. He also has exempted spouses and children of USC in every EO. So I don't think we're his main target. I could be wrong, but I'm going to go by what he's done in the past. . .

Also, If this takes affect does anyone know if those who've already applied would be excluded from the new rules? I know we don't know, but just was curious about people's thoughts. Just a hypothetical question. :)

family imigration still works well with merit based, by ensuring people can speak English and hold at least a high school certificate, and that spouse is employed and can care for them.. Aus has never let unemployed or students act as sponsors, which I think is fair since it is tax payer money afterall. 

 

I honestly dont think merit based systems are anything to be scared of provided your a honest hard working person, with honest intentions.

considering US is the world's super power and has had family immigration for 100+ years, there is nothing to say to need to shift to merit basis. it has worked wonderful for this country. Infact it has worked the best in the world. Sure Aussi might go with merit but one solution does not make it any better than the US
