Vaccination Question for K1 VISA

Timeline

Hi everyone! Hope you're all keeping sane during this crazy time in our lives. 

 

I have not received NOA2 yet; I am just trying to gather the documents I need for the interview as things are closed and things are taking longer than usual to process. 

 

Regarding the vaccines for the K1 visa - there are a couple of them that I do not have; please refrain from starting a moral debate. 

 

Would a note from my family physician be sufficient to be a waiver for exemption?

As a K1, vaccinations are not mandatory at the time of the medical. You can decline being vaccinated.

 

The issue will arise when you file for AOS.

You will receive an RFE and then you can request for a vaccination waiver due to religious belief or moral conviction, which will be granted at the immigration officer's discretion.

So when I go get the medical done, I can tell the civil surgeon that I decline the vaccines and will deal with it later?

That is sufficient for getting my petition approved at the consulate?

Correct. Lack of vaccinations won't have an effect on the visa approval.

 

But again, the problem will come when you adjust status in the US.

The vaccines are costly, most civil surgeons charge for the whole medical again -not just the vaccinations-, if you do not send a complete vaccination form your case will be delayed and if you ask for a waiver and it is not approved, your case is at great risk of being denied.

Yes can can delay vaccinations and do it in the US.  It can be a big hassle later - it is much better to do it a the medical so that it is marked complete.

Yes,  your are applying for a non immigrant visa and it isn't required for non immigrants.

Only in the rare exception that it would not be medically advisable, but that will be reviewed in the US when you go to AOS.

 

You are only looking at 3 possible vaccinations (plus flu if it is flu season).  You can also have a titers done.  Mary did this for work showing she didn't need boosters.

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

On the website of one of the authorized clinics, they mention the vaccination records as a mandatory requirement to go through the medical, as the clinic does not offer vaccination. 

 

If that is the case for all authorized clinics -or as you mention, drs. do not release the medical without vaccinations complete-, then @onepr1cklypearshould either get vaccinated or get tested for immunity.

Yes unless you can meet the high bar for a waiver you MUST get the necessary vaccines or they will not release the medical. This as far as I know is only mandatory in Canada.

In Canada vaccines are a must or they do not release the medical even for a K1. They are required if you want to complete your medical.

As mentioned above vaccines are required in Canada there is no delaying them or waiting until you enter the US. You would still need them at the time of AOS

Depending on your age only certain vaccines are needed. What vaccines are the ones you think you need? It maybe possible they do not apply.
