My husband and I already filed our I-130 with the USCIS in March when Dublin Embassy was closed to DCF. We are now planning on withdrawing our I130 and refiling with Dublin Embassy because DCF seems to be so very much faster. We have received our NOA1, and no further touches or anything. A fellow VJer from Ireland who also filed in March, but with DCF, has already received Packet 3.

Questions. . .

1. Do we have to wait for a response to the withdrawal for I130 before proceeding with DCF filing? Can we wait till we receive receipt of I130 from London before withdrawing previous I130?

USCIS guy says, well there will be a response to the withdrawal, you can wait for that. We dont know if you have to.

2. The checklist, regarding the G325A says this

"Only one form to be completed by the petitioner and one form by his/her spouse. Do not submit multiple copies (even though you might see instructions elsewhere to do so)"

The G325A form automatically fills four sheets. Are we supposed to only send 1 of these 4? Did anyone else only send one?

3. The checklist, regarding photos, it says to only send one of petitioner and one of spouse. While filing with USCIS they ask for 2. Did anyone else only send one?

4. I130 C.16 Has your relative ever been under immigration proceeding? Do we count the I130 we are withdrawing, and the I129 we have already sent a letter to withdraw. If you check yes, you have to then check deportation, removal, recission, judicial proceedings.

I called USCIS and spoke to 2 different people. One said put no cuz none of those options apply to us (even though recission means to void). the other one said they cannot assist us in filling out the form and to seek the advise of a legal representative. huh.

I would not at all be surprised to be refused for not having 2 photos each, even though the checklist says 1. I just wanted to make sure others have had success following the checklist. I would hate to be refused since the only progress we seem to be making is withdrawals.

And we have tried calling the Embassy. The woman at the embassy knew NOTHING, other than they receive petitions in the mail and send them to London. For the ? re photo and G325 she said to just do whatever it says. Just wanted to check with you guys before mailing.

Any help would be greatly appreciated.

may 28, 2007 - NOA1 I-129F

june 5, 2007 - I-129F transferred to California Service Center
