Buying time in Mexico

Timeline

Hello everyone,

Since our case has been silent for over a year now, my husband decided to quit his US job, move to Pakistan and wait the I-130 out with me, here. People he works for have been very understanding and have introduced a new idea. They suggest he moves to Mexico, continues working for them from their unit in Mexico... I join him in Mexico and we wait there till our I-130 is approved. After that, we can move to the US together...

Now, if that works out... and the I-130 gets approved, I understand I will have to go to Pakistan for the interview. There are a couple of things we are worried about, in that case...

  • How will we convince the Embassy in Pakistan that my husband will move back to the US as soon as I get my visa?
  • Should he return to the US as soon as I get an interview date? (We are scared of the L.O.N.G. AP/AR they're going to put me through AFTER the interview).
  • Has ANYONE out there done this before? Move to a third country while waiting for their I-130's approval?

We've been waiting for a very long time now... and this idea just ignited some enthusiasm... that at least we'll be living together. Plus, Mexico's got to be fun! :help:

Will you easily be able to get a visa for Mexico? That might still be problem....

I don't think you have to convince the embassy that your husband (the USC) will be moving back to the US. It is important that he is making enough income to sponsor you, or can find co-sponsors, etc.

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

11/18/2007 - 129F petition received at embassy

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.

You're right. Getting a visa for Mexico may not be a piece of cake... but since his company would be sponsoring the visa, we think it won't take too long.

Two people have to get a visa to Mexico but only one needs to be able to work there. If the Pakistani can get to Mexico, it is probably workable as long as the USC maintains US domicile. That's pretty easy. A letter from the employer indicating he has a job in the US as soon as both are ready to travel home, is probably sufficient, since it is the same employer.

I think the wife will either have to plan to return to Pakistan twice or wait out any AP time in Pakistan after the interview.

Facts are cheap...knowing how to use them is precious...

What type of visa do you plan on getting for Mexico? A tourist visa will only allow a stay of 90 days.

Hey I noticed that most K-3's from our time line got transffered out of chicago because they no longer process K3s there. Mine never got transffered nor did I get a notice or status update saying that they were moving it to the CSC like the rest of the applications. Its back to you and me just at the mercy of USCIS. I dont understand why this is happening. I get so scared that they just lost our applications or something. But as you are used to by now like me the congressman says that they are not lost just stuck in futher review or administrative review and all thoes other facy words they keep telling us. =0( What should we do now? Both of us have waited and waited and contacted every one we could for help, we have exausted our resources at this level. I have not written to the Obudsman yet becaues from what I hear they don't really help. I wonder if writting to the FBI to ask about the status of the USCIS checks would help. I know its a long shot but you and I have we have been waiting for so long just to get our NOA2 for USCIS. I have not met any one else that is in our situation. People have requested FOAI and they say that its a waste of money because even after a year they still have no reply. Many of them have had better luck sending their fingerprints to the FBI along with a check and requesting the checks themselves. There has been an average 4-5 month wait to get back the reply with the FBI. even thought of sending in a an envelope as an RFE with additional evidence of our marriage like they now request. When we filed that was not required all our lawyer sent in was the wedding certificate. Im just screwing in the head right about now. Have you come up with any ideas?
