Hi,

  So i want to file jointly with my wife who entered on cr1 immigrant because i want to avail stimulus checks and also i will be in lower tax bracket. Tax filing deadline is in a week and her green is being produced ( according to status online so we r expecting it in a week or more) , we didn't recieved ssn, and it will take atleast a  week for that as well, maybe after we get green card. So i want to delay filing tax for 2019.  i dont owe anything to irs for 2019 and likely to recieve back money from irs.

   I do have a few questions if you guys can help please and give your input. God bless.

 

1) what is the best/easy way to ask for delay in tax filing with irs and state of Oklahoma.

 

2) what impact it would have if we file late ( in terms of my wife doesn't have ssn now and wont be able to file for extension as she doesn't have ssn yet so file against what no. for her extension) ..confused. would they be saying, you didnt file for extension??

 

3) what documents are needed to file for extension?

My friend just filed an extension  because he is waiting for his wife ssn too.

 

He used taxact to efile the form 4868 for federal. For states(California) , you automatically get 6 months.

 

"We give you an automatic 6-month extension to file your return. You must file by the deadline to avoid a late filing penalty.

The deadline is October 15, 2020.

An extension to file your tax return is not an extension to pay. Pay the amount you owe by July 15 to avoid penalties and interest."

Thanks, did he file extension for his wife too? Do you need to mention if you are filing single or jointly, if so what to do if she doesn't have ssn yet?

I think the penalty for late is around $300 if you don’t have any tax due like you said.  
 

More information needed before I weigh in on your problem. 

  1. How are you doing your taxes? Software? Which one? Online or did you install it on your computer?
  2. Do you have a joint return already completed, except for the SSN?
  3. Did your wife work in her home country any part of 2019? What country? 
  4. If she worked, have you included her foreign earnings on your joint return?
  5. Have you also completed a Married Filing Separately return for comparison? 

i wouldn’t worry about the stimulus right now. Didn’t you already collect that based on your 2018 return?

1. I usually do taxes  through liberty tax in person with them, i was thinking i will have my wife ssn before july 15, so i didn't start anything. I dont know much about online i did use turbotax few years ago.

2. Nothing even started yet.

3. No work by wife in 2019.

4. No income of her in 2019

5. I have not compared, however since i wasnt sure she would be able to get visa and join me in 2020, so my employer was holding taxes as i was going to file seperately, so i was paying more because if i file jointly i will be in lower tax braket as she didn't have income. I assume i will be saving atleast $2000 if i file jointly. I did some math in my head based on tax brackets.

 

I collected stimulus based on 2018 income, however since if we file jointly for 2019, i want to get eligible for my wife also, because she didn't get as she wasnt on irs record.

 

What do you recommend?

What I would do given the short amount of time you have:

 

File the extension for yourself with only your name and SSN. You can fill it in by hand and get it in the mail Monday. It needs to be postmarked by July 15 and you are covered against penalty. Your wife has no obligation to file so she isn’t late. You can still file a joint return later when you get the SSN. 
 

The form  https://www.irs.gov/pub/irs-pdf/f4868.pdf

 

You have to estimate your total tax liability for the form Line 4.

Tax Tables https://www.irs.gov/pub/irs-pdf/i1040tt.pdf

Do you know how to use the tax tables provided by IRS? A way to estimate is.

  1. Add up all your income— Salary+interest+dividends (any money that got paid to you)
  2. Subtract your standard deduction of $12,200 (for just yourself). Result will be an estimate of taxable income.
  3. Go to the tax tables and find that taxable income. Use the Married Filing Separately column to find your tax liability. That is the number for Line 4 on the extension form. 

That is just to determine if you need to make a payment with this form. If you had more held out of your paychecks for Federal Taxes (goes on Line 5)  than your tax liability (Line 4), then no money needs to be sent in with this form before July 15.

The form says Name(s) which means a single name or two names.

i am saying put only your name on that line.  Then only your SSN. Spouse blank.
Get it? 1 name, 1 SSN, and Line 4&5 as if you were married filing separately.  That takes care of your extension without explaining the wife’s lack of SSN. it seems easier to me to get it done without wondering how to explain.

Ok , got it, thanks.

      However, i just remembered that i had money in saving account that i earned interest on it. I did pay all my taxes on my earning at my job , it was withholded as if i was filing seperately. But if i had to pay tax as single i will have owed little bit tax based on few hundred dollars i earned in interest as nothing was witholded on that earning. However if I am filing jointly i believe i have paid more overall given different tax bracket.

   So given that, now with extension that i am filing as i would do as filing separately, do i send money order for tax i owed on  little interest that i earned? Even though i am expecting to get money back when i file jointly. just send money with it and it will be adjusted later on no worries? Or no need to send money.

   Sorry if i am confusing,  but i really appreciate your help and input

Are you saying that the amount of tax already paid the IRS. (See your W2 statement, box 2) was not enough to cover a small amount tax that interest bumped you up. That couldn’t have bumped your tax much. Surely your paycheck withholding wasn’t that close to your actual tax. It doesn’t matter who held it out. The job withholding can cover the tax on the interest.

 a)  i overpaid $2000 on my w2( because my employer withholded as mfs but now i plan to file mfj once wife gets ssn, so paid $2000 extra because of different tax bracket as wife had 0 income)

 b) i owed $100 tax to irs on interest that i earned on saving account. 

   

So In this case

 irs owes me back $2000-$100=$1900 approx, if i would file MFJ.

Or

i owe $100 to irs if i would file as MFS

Right? 

 

Now , since i am filing for extension without wife ssn,  and you are suggesting me to file for extension without wife name just as i would file as MFS( for extension purpose only).right?

So in case of MFS, I would owe irs $100 given above example , so do i send $100 check with extension?

  Or i dont send $100 check because i am going to eventually file as mfj and in reality irs would owe me $1900 given above example.

  QUESTION IS: do i send check of $100 with extension?

Sorry, I can’t follow you without income amounts. Who owes you how much does not let me know how you are getting those numbers or if you are doing it correctly  You said you earned a “few” hundred in interest (as reported on your 1099-INT).  So if you had $99,000 in taxable income (after you took off your $12,200)—Then $200 in interest earned would only raise your taxes $48. Yet  you say it’s $100.  Maybe you make $200k a year. Maybe you earned $10k in interest. Too much to guess.
 

I basically do not think if you file MFS that you would still owe $100. Maybe so but without MFS numbers I can’t be of help. 
 

 It doesn’t sound like you have filled out the Extension form lines 4 and 5 as MFS (ignoring everything about your wife) to see what the numbers are.  You have never confirmed that.  What number is on Line 6?
