Need advice fast

Hello All,

To make a long story short, I met a Russian woman in the USA, we dated for 4 months, she moved to Russia, we visited each other twice during that time (8 months), and then I moved to Russia to live for the last 10 months. Monday we got married Yay :) ! So now comes this awful visa thing.

I understand I have two options, file in the USA or file here. The main problem is I do not have a job. I do have sponsors in the USA, my mom and dad (60K+$) and sister/husband 50k$ per year. Both have said they will co-sponsor us.

Is it possible to start the process here in Russia and then finish in the USA. I am moving back in 3 weeks. How does sponsorship work in this case? I want to do whatever would be faster.

As far as proof a real marriage, I don't meet any of the criteria set out in the K3 guideline. I do however have people who will say this is a valid relationship. I also have photos, e-mails, etc.. from day1 (2 years now we have been together). I am only worried about money. My marriage is real and any consulate will see that based on the evidence.

Please advice. The US government websites are hard to navigate.

June 26 2007: I filed the I-130 in Saint Petersburg Russia

July 4 2007: I return to the USA

July 9 2007: I receive a request for additional information

July 11 2007: They receive the information

August 2 2007: I receive a letter from the DHS that the process is complete and sent to the embassy

August 15 2007: Vicky receives packet 3 and 4.

October 2 2007: Vicky gets the visa

DCF is fast and the way to go.

call the uscis regarding that matter i think the uscis can advise u? I think if u want to fileD K-3 better u filed in the U.S. becaz that fast.. then follow 1-129f-

When you file directly with a Consulate abroad, it is for a CR1 visa, not K3. That aside, I think your best option is to file DCF because the whole process will be faster. Then you returning to the US to re-establish domicile and get a job is perfectly ok. Citizen spouse's commonly do this during the DCF process. The fact that you have been living together for 10 months pretty well attests to bona fides of your relationship. Getting a couple affidavits from people who have actually observed the relationship up close and personal, will take care of any lingering potential doubts.

Yep... absolutely, DCF is much faster for you, bypasses the who USCIS Service Centers, which take quite a while to process your petitions. As for the bona fides criteria on the 130, you meet them fine. Are you on the lease, have utilities in your or both name(s) at her place, etc. will do. If not, 2 or 3 affidavits attesting to your relationship will do.

03/12/2007 - Married to my beautiful wife

04/16/2007 - Sent I-130 to VSC via USPS Express Mail

05/12/2007 - NOA1 received by snail mail after a loooong wait

05/14/2007 - Sent I-129F for K3 to Chicago Lockbox via USPS Express Mail

10/22/2007 - I129F APPROVED (161 days), I130 APPROVED (188 days)

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

11/18/2007 - 129F petition received at embassy

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.

Yes, DCF is quicker route for you.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
