Regret filing form I-407

I filed form I-407, Record of Abandonment of Lawful Permanent Resident Status in May after an argument with my husband. Then I fly back to my homeland. Of course now I regret doing such a foolish thing. I received noticed from immigration they recorded my request. Now I have no green card. Can I fly to the U.S. to work on getting my status changed or will I be turned away at the airport? Will they give me another chance if I do enter?

Thank you for your help.

Elena

You have no status to go back to. If you're still with your husband, he needs to file a new I-130.

What status would be changed? You gave up your residency. Are you still married /have you reconciled? Your husband can apply for a spousal visa.

I have no idea what this means, on what basis will you be seeking entry, what do you want your status changed to and how do you intend to do that.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

You cannot enter without legal status to do so. You are no longer an LPR. You could try applying for a tourist visa but being married to a USC who still resides in the US will be a big hurdle to overcome in convincing the CO  that you’re not going to stay. If you were successful in entering on a tourist visa , you cannot stay and “ work it out”  You can visit but you must leave after the visit.  Best course of action is for your husband to visit you, spend time together and reconcile , then he will apply for a spouse visa and you must wait in your home country while it is processing .. 12-18 months. Good luck

Thank you for answering. My husband isn't sure he will support me in this because "I gave up on us so quickly". At this point I just want to fly back to the U.S. and try to work things out with him, but he thinks I should stay in my country to think about it and be sure this time. I understand his point, but is there a way for me to go back without starting the process all over again?

You can visit as a tourist, well with COVID there may be complications.

No; to obtain legal residency he would have to sponsor you again. Husband can visit you and/or you can meet up in a third country, work things out via Skype, etc.

Unfortunately, no.  You will have to start the process all over again.  Your husband would need to file an I-130 and it will take 12-18 months for you to get an immigration visa.

I would suggest starting with some Teletherapy- marriage counseling. It sounds like he is not ready for you to come back, and he can take his time in filing a new I-130.
