Technically she is now in a visa overstay and could be subject to deportation. Although she should be able to get married under state law, I'm not sure how that would affect immigration status being that its passed 90 days. Bans for overstays dont kick in until 180 days. So its possible that she could get married and it will all be fine. But I really would suggest getting legal help in this situation before you do anything.

If not married in the 90 days she is required to leave the US. If she doesn't leave she will be subject to deportation and possible fines plus possible bans on returning.

There are no extensions on the 90 days!

The OP or her fiancee would have to had been in a coma to not know the requirements!

Or she is just playing games with us.

why didnt you get married within the 90 days?

i dont know. I thought it would be fine because i have a sister in texas right now and they also got married after almost 2 months that thier 90 days expired. But the reason why is because she lost her visa a few weeks after she arrived US and they filed an affidavit of lost and reported it to the USCIS. Am so stupid that i just think about it right now. I dont know what to do. Am so upset right now. I dont want to go back and start all over again, it sucks.

You dont have to staet over again you just have to file form I-130 along with the AOS packet as soon as you can and DO NOT LEAVE THE USA until you have your Greencard....

Go and have a chat with an immigration lawyer....
