Hello!

 

My husband and I have received an RFE today. It states the following is required:

 

”Submit all supporting tax documentation (W-2s, 1099s, Form 2555, and all supporting tax schedules) submitted to the IRS for the most recent tax year”

 

”The petitioning sponsors household members, Darrel, must submit all supporting tax documents for the most recent tax year” 

 

So do we just need to send in Darrel’s documents only? Also, due to covid he still hasn’t filed his taxes for the most recent tax year. We sent the past couple of years across showing his income from his pension which exceeds the 125% poverty guidelines. 
 

What would you recommend given he hasn’t filed taxes yet due to COVID? As the year hasn’t ended I thought it would’ve been fine to present past evidence?

How has Covid prevented filing taxes?  In less than 10 days, 2019 taxes are due.  Personally, I would file for 2019, then send tax documents for both sponsor and joint sponsor.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

My in-laws who are sponsoring me own a business and have to go to a company to get their taxes done which has been shut. They’re in a rush to get it done now by the 15th, but I was hoping there would be something else i could submit for past years instead of having to wait on them.. 

 

Would there be anything I could submit. Or am I going to have to wait. We did send the sponsors documents for this year so I’m assuming they just want the joint sponsors?

The tax deadline is next week so once he files he can submit it; you have time to respond to the RFE (probably 3 months?). Also, specifically, what supporting financial documents did you submit for Darrel?

Since the filing deadline is so close, I think there would be a high chance of getting an RFE if you send 2018 tax documents......which would delay your case.

Their taxes will still be due on July 15th.....whether the tax business is open or not..

Sometimes these RFEs are because you did not supply the complete tax return info for the spouse. They won’t consider the joint sponsor without correct documents for spouse. 
 

Do you have a photocopy of your supporting documents to go over?
