July 2020 AOS Filers

I finally got the RFIE. Apparently, they did not accept our I-864EZ. Anyways, we'll be sending the I-864 instead.

Does anyone here know what "tax schedules" are? It was one of the required supporting tax document they were asking for. We tried to google it and was given the pdf copy of: TAX AND EARNED INCOME CREDIT TABLES which I'm sure isn't what USCIS was asking for.

Aug 27, 2020 - Hard copy of RFIE received in the mail (I-864EZ rejected) | Aug 31, 2020 - Response to RFIE sent to NBC

Sept 9, 2020 - Response to RFIE received by USCIS | Sept. 22, 2020 - Received I-693 deficiency notice

Nov 21, 2020 - Date USCIS sent out biometrics appointment letter  | Nov. 28, 2020 - Received bio appointment letter

Dec 18, 2020 - Biometrics appointment completed in Brooklyn ASC | Dec. 19, 2020 - Case updated to fingerprints taken (I-485 and I-765) | Dec. 30, 2020 - Case is ready to be scheduled for an interview

Feb 25, 2021 - New card is being produced (EAD) | Feb. 26, 2021 - EAD and AP have been approved

Mar 3, 2021 - Combo card received | Mar. 5, 2021 - SSN card received

Aug 31, 2021 - Case updated online to interview has been scheduled | Sept 8, 2021 - Interview schedule received in the mail via USPS

Oct 5, 2021 - Scheduled interview | Oct 6, 2021 - Approved

Hi,

 

I have applied for I-485, I-131 and I-765 in August 2020 for employment based EB2. Application will be sent to National Benefit Center (I was told that). I am wondering: How long did it take to get receipt notice for National Benefit Center? How long did it take to get biometrics appointment?
 

Also it seems that their I-131 processing times are fair now (according to their web site) but EAD card time at National Benefit Center is RIDICULOUS. Could first receive Advance to Parole and later on EAD card?

Schedule are usually what you file with your 1040. Mostly include Schedule 1, 2, 3 and D. (For ex: Schedule 1:https://www.irs.gov/pub/irs-pdf/f1040s1.pdf)

If you file your taxes manually you should already know what these schedules are. But if you use TurboTax just download recent copy it should have these schedule forms. Otherwise best option is to just send USCIS your tax transcript that will summarize everything for them.

Note: Schedule forms are supplement form to tell IRS more information about your deduction.

You should post this in Work visa thread. Family Based petition have different timeline all together. 

But usually to get the receipt its between 2-3 weeks from the day USCIS received the package. You should not worry about EAD/parole assuming you are on H1B or some work visa currently and if Yes you can travel and come back as long as you have valid visa and USCIS won't reject your AOS package since H1B/L1 work visa are exempted. Read I-131 instructions.

Should I just send the whole thing? My husband used Turbo Tax and if I remember correctly, the whole report has a couple of pages. Should I also send the 2017 and 2018 tax reports? I just don't want to keep getting RFIE'd as they might just reject the whole application for the back and forth 😅

Basically I am on an O1 visa status. Hence, if I leave without approved advance to parole I am abandoning AOS. I guess and hope that advance to parole will be approved before EAD (if EAD takes like 30 months).

I would recommend sending IRS transcripts if you can get that. If not, send turbo tax print out (exclude the state forms). Yeah, safe to include 2017/2018 info as well.

Ohh right, O is not exempted. Usually 765/131 should be processed together since EAD card carry parole annotations.

 

I don't think so it going to take 30 months when almost all USCIS staff is resuming their work.

Yes this is my belief too. It is so ridiculous though that Advance to Parole processing time is up to 5 months and EAD card to 30 months. ####### ;) 
 

 I am looking other employment and family based petitions and they are not taking that long. USCIS staff should process much of the backlog. I think USCIS has cut budget spending for the third party company which is printing those cards. This is the issue as far as I have heard

Timeline

 

Hi guys, I concurrently filed for AOS with the Forms I-130 and I-485.  Mailed out on July 31st, USCIS received the package on August 1st.  They cashed the check for Form I-130 today August 28th ($ 535 USD), but did not cash the I-485 & Biometrics check ($ 1225 USD).  Do you guys know if USCIS usually cashes first one check and then the other one?  Or do they use to cash both at the same time?  I want to stay positive and don't think that there is an error on the I-485 or other forms (I-131, I-765, I-864, and I-693)

Well got an RFE dated the 28th (today) I was checking my case status  on the uscis website and saw that it was issued I think it’s the birth certificate

New York or Bay Area is a “joke” for waiting times. Also it depends on your case. I have seen some H4 renewals to be “frozen”. Maybe an administration choice :(

Have you done biometrics inside the US at a ASC before? If so, the following reuse notice might be a possibility: "U. S. Citizenship and Immigration Services (USCIS) has received your form and is currently processing your application, petition, or request. This notice informs you that USCIS is able to reuse your previously captured fingerprints and other biometrics. USCIS will run the same security checks and use your biometric data as in the past, however, it is not necessary for you to appear at a USCIS Application Support Center (ASC) for a biometrics appointment."
