My mom got the RFE. They want her birth certificate/translation and my birth certificate/translation. This was already sent, not sure why they need it again? thoughts anyone?

We too got a RFIE for submitting the wrong type of birth certificate (from P.R.China). We had to request a document to be created for us by a notary in my wife's hometown (we've responded to the RFIE with a copies of it, and are currently waiting for the original to be delivered to us).

My suggestions would be to:

  1. Verify the type of required birth certificate (https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country.html).
  2. Verify translation is complete.
  3. Verify a document was with the verbage similar to: "I, [typed name], certify that I am competent to translate from [the foreign language] into English, and that the [above/attached] document is a complete and accurate translation of the document attached entitled [name of document].".
    1. The document must be: signed and dated, and contain contact information of the translator.
  4. I've read that it should contain date of birth, place of birth, and parents names, but I'm not so sure about those requirements.

Wow took them almost 1 month. Kind of weird since i have also seen some people getting updates on cash out within just a week.

Hello guys,

here is a curious fact on our case,

filed on December 2019 I130 , due to Covid 19 , AOS had to be done and received on july 16, 200 . I130 approval notice on July 20-2020 (same week of aos package was received at Chicago lockbox)

july 23 , i130 sent to department of state.

almost a month now and i have not received noa1 from i485 EAD or I131 , is it related to my i130 sent to Department of state?

i am starting to get worry since the i94 it is expiring on september.

thanks

Do note that the I-130 approval doesn't expire. But at I-485 interview if the I-130 file hasn't arrived from the internal transfer request, then it can delay I-485 adjudication.

Im so dejected and at a complete loss right now. Our FOURTH AOS submission is being returned to us, according to the call we just made. "Filed Improperly" is the only reason the agent could give us. Im beside myself. I sent the correct fee. Combed over every document. Checked and rechecked we included everything. First packet was sent in MAY. I have no idea what we are doing wrong, or when we will ever get this packet thru.

Sorry to hear that. Where do you live? See if you can find someone on this group who lives near you and can just go over your docs/application one more time.

Our experience with rejection was that the stated reason was wrong, but related to the true reason.

I wonder if your payment amount is correct but the procedure is wrong somehow? For example, a check is written to the wrong payee? Or maybe a credit card address is wrong? Or the payment info isn't in the first few pages of the submission? Can you visit your bank and ask them to look over the payment document?

All the best...

I'm sorry it got rejected again. Maybe you could consult a lawyer to go through your files? There might be some lawyers  who won't charge the entire fee and just the fee for checking through your files making sure it's correct.

Hopefully uscis will accept it the next time without rejection 🙏
