Timeline

Hello All,

 

I was just wondering if there is anyone recently got approved for B2 extension, filing due to Covid 19 and not able to go back home.

My sister got stuck in here so we filed for an extension before her I94 expiration date, on the USCIS website now showing the processing time is 2.5 - 4.5 month.

Her application was received on 04/13/2020.

any response regarding the same would be really appreciated.

We’ve seen a number of reports of filing extensions, I don’t think I’ve seen anyone report receiving a decision yet. Processing of i539 was typically running 4-6 months before Covid so will probably take a while for everyone to hear back. Suggest your sister take the first flight home she is able to, and she needs to keep records of (1) the application (2) any decision she gets on it (3) proof of her exit from the US. I’ve seen reports of people being asked for these even years later at subsequent B visa interviews.

I believe Egypt has opened up for international flights as of July 1

When did her i94 expire? If that date is passed, she has already overstayed of course. However, she does not accrue unlawful presence while a decision is pending. If she is approved, the approval backdates to her original i94 end and the overstay is retroactively cleared. If she is denied, her visa is voided automatically, and she has to leave immediately (no grace period - from that point any further stay counts towards unlawful presence). In addition to that she can then only apply for any new B visa in her country of nationality, though that is normally only a problem for people residing in a third country. The bigger problem is that a voided visa and an overstay makes it very hard to get a new visa.

If she gets denied her visa would be cancelled and it would be extremely difficult for her to obtain another B1/B2 in the future. Since airports are open and she overstayed due to not being able to go back home due to COVID, but now has a way to go back home, it would only be right/make sense that she goes back home ASAP. Like the above poster said keep a record of the application, decision and proof she left the country.
