Hello all,

 

I have a question regarding form I-864 affidavit of support.

 

Currently, I am in US waiting for my naturalization. I might get US citizenship by next year(2021) June. My wife is currently waiting for her spousal GC in my home country. It has been already 2 years and because of all these covid 19 delays I fear that there could be a delay of another 2 years or so. This separation is very painful, so I am planning to go back to my home country once I get my citizenship and continue the immigration process for my wife from there. I already have enough savings to show as assets for affidavit of support (3 times of 125% of minimum income).

 

Is it OK to leave my job in USA and go back to my home country until my wife gets her GC? Are there any other challenges I might face regarding my wife's immigration if I leave US?

 

Any advice will be of great help. Thanks

Will your savings dwindle while you are abroad? Also don't forget that the 125% is a guideline and the COs ultimately decide if they feel she will be a public charge or not.

Your challenge will be proving domicile in the US if you decide to move abroad for an indefinite period of time. 

 

Domicile: Place where a person has his or her principal residence. The person must intend to keep that residence for the foreseeable future. The sponsor of an immigrant must have domicile in the United States before the visa can be issued. This generally means that the sponsor must be living in the United States. In certain circumstances, however, one can be considered to have a domicile while living temporarily living overseas.

Also, health insurance.  COs look at the totality of circumstances when evaluating the public charge risk, not just finite numbers.
