Applied to ROC on End-March 2019 (Vermont to Potomac) and Citizenship on Jan 2020(NYC) - No Update

Hi Everyone,

 

I wanted to share my timeline and see if there are other people who have a similar timeline/issue.

I submitted my ROC application at the end of March 2019, my application was transferred to Potomac on Mid-December 2019. In addition, I applied for a citizenship on January 2020.

 

The problem - My extended green card is about to expire on October 2020 and I am afraid to have a problem with my current work. Is it possible to continue working if my green card in expired in the current circumstances (COVID-19)? Is there anything that I can do in order to push USCIS to review my application? I wonder if my application got delayed because I applied for citizenship and NYC is still closed. 

 

Should I involve my managers at work? Thank you for you help!

A green card is only evidence of status, not status itself.

An employer is not supposed to re-validate employment eligibility if you presented a green card last time they validated eligibility.

 

If you need to complete an I-9 after expiration (i.e. if you apply for a new job), and don't have an unrestricted Social Security card + valid driver's license (these can be used instead of a green card for employment eligibility), you can use a I-551 stamp instead.

If you need to travel abroad, you will need the I-551 stamp.

You can get the stamp by contacting USCIS - generally starting within 30 days of expiration - to setup an appointment. Or you can do so sooner with evidence of need (i.e. an airline ticket).

Their specific policies on giving the stamp with COVID procedures/restrictions is local.

 

Your managers at work have no influence in the matters of USCIS.

The VAST majority of jobs do not need to reverify your status. You don’t need to tell your employer anything. USCIS offices just opened up a month ago so it’s normal you haven’t heard about your N400. If you haven’t heard anything you can make an infopass appointment Sept for another extension

Your employer does not have to reverify green cards but IS legally obligated to reverify your extension letter upon expiry. See below:

USCIS are only doing the i551 passport stamps in case of an emergency, fortunately I believe your employer asking for recertification counts as an emergency. You can get an appointment 30 days before your extension letter expiring.

Only if that is what was used to get the job in the first place. As someone else responded. If the green card was used to get the job or Social + drivers license then they are not required to reverify.
