Can you share with us how your fiancée wears able to get an emergency interview?  I’m trying to get one too and as yet have had little luck getting the paperwork to be sent out from the NVC....  Was her paperwork at the consulate already?

It depends what you mean by "getting an approval" to leave.

If there's a flight out, she has a valid visa, which (one hopes) would convince the airline.

Getting aboard the flight is the chief challenge.

Once she's on the flight, chances are good that she'd be admitted to the U.S. by CBP.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I am an officer in the navy reserves and an officer in the US merchant marine. I ship out in October and got my work to write me a letter to get an interview. Our stuff was already in Sydney!

All I am asking is whether or not anyone has had luck getting an approval to leave Australia from the Dept of Home Affairs.

That's not enough for the Australian government sadly. :(
I am still waiting for my exemption with my visa and everything canceled and shipped. Haven't heard back yet.

Ah -- country-specific.

Have you contacted Home Affairs directly?  Do you have a political representative to ask for help?

Unfortunately not that easy ., she needs to be granted and exemption from Home Affairs .. there is a ban on all Australian citizens and residents leaving Australia. Some K1 holders have reported being successful in their application for an exemption

You can apply online, for free to get approval to leave, approvals however are a little hit and miss from what I’m hearing 50/50.... takes around a month to six weeks and getting longer,  so don’t dilly dally in applying or k1 will expire.. 

 

I think the key here is to prove there is no intention of hubbies returning to Australia, the intension of the ban is to stop Aussies bringing the virus back to Aus.. a lot of emphasis needs to be placed on explaining how the k1 works, eg, immigration permissions to enter US, marry and AOS with intent to reside permanently in the US.

 

Unfortunately the stupid government hasn’t put a exemption in for those migrating out of the country, it’s mostly humanitarian, political or medical... but logically, we should be able to leave as we pose no risk of taking the virus to Aus, provided of course we go through with the wedding and adjust.

Apply for an Expidite via NVC, but you’ll need to meet and prove why, shouldn’t matter if paperwork is at NVC or consulate, they work together at this point

Add this to your application.. military and AOS as mentioned above, your case is stronger now, our gov usually things in place for military personnel and family..

Hi! Not sure if you have had any luck yet with your exemption. I recommend putting your travel date within a week of applying for your exemption- you will get your approval or rejection faster that way. Once your exemption has been approved, it is valid for 3months (some people are saying it's valid until you use it). Make sure you put your return travel date years from now as well. A lot of people have had to apply 8 times and then on the 9th try they get it. It also depends on the officer reviewing your application.
