Does Tax Return Need to be Amended

Good morning, my husband and I are finally at the NVC stage and I'm trying to figure everything out as far as where and how to get started with these forms. Our fees have been paid and have posted my first question is trying to figure out if I need to amend my 2019 tax return. We were married in April, 2019, however  I filed head of household only using my son who's a college student. Does my return need to be amended, and if so, to what? My husband is unemployed at the moment so he had no income. I'm a tad bit confused. The second question is, if the taxes need to be amended can I upload what I have now and once amended he take it with him to the interview?

Did you file as married or single?

Consulate Received : 10/6/14 CEAC status changed to ready

Packet 3 Received : 10/27/14 packet received by petitioner in USA ( beneficiary never received packet 3)

Medical: 10/30/14 Dr. Buteau                  Medical picked up: 11/3/14

Packet 3 Sent : 11/10/13.. Had to schedule interview appointment and attach confirmation receipt to packet

Interview Date : 12/1/14                           Interview Result : Approved !

Visa Received : 12/10/14 picked up at Jacmel location

US Entry : 12/15/14 Fort Lauderdale, Florida

Apply for Social Security Card: 12/30/14 Connecticut

Marriage: 1/26/15

 

Adjustment of Status

NOA : 3/25/15                                            Biometrics : 4/15/15

Approved: 8/31/15                                     Received: 9/8/15

Removal of Conditions I-751

Filed: 8/14/17 at VSC                                 NOA: 8/15/17 Received 8/21 by mail

Biometrics: Dated: 8/25/17   Received 9/2/17   Appointment 9/11/17 

Approved: 10/23/18 -no interview

If you were apart from July-Dec of 2019, you probably legally qualify for HOH.........that might be the best strategy for your situation.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Either HOH or MFJ or MFS fits your case

you are married so can not file single

you could claim your spouse by filing the W7 and proofs of marriage and documents for his nationality or birth per IRS instructions

at this time u need to amend 1040x form to add spouse if u did not include him if you do MFJ 

you can not claim him if you file HOH or MFJ

 

To qualify for the Head of Household filing status while married, you must: File your taxes separately from your spouse. Pay more than half of the household expenses. Not have lived with your spouse for the last 6 months of the year.

 

if he has no income,  MFJ is beneficial
