I am a us citizen , I petitioned my wife last year November 2019 (i130 & 485) . She’s from canada , holding a TN Visa . Her TN visa will expire march 2021. We are waiting for interview so she can get her permanent resident but due covid there is delay in process. Can she renew her TN Visa now that petition is under process? Worried she might stop working. What the best thing to do?

Probably have a hard time proving nonimmigrant intent

From what I can make out a TN visa holder will not be able to renew their TN, or apply for a new TN with a different employer after applying for AOS. (The filing of an AOS application is a significant sign of immigrant intent, which conflicts with the temporary entry requirements for TN status.)

 

might be worth considering applying for work authourisation rather than a new TN visa

  • New Card is Being Produced 25 September 2021
  • 10 Year Green Card Approved and Mailed 27 September 2021 🙌🙌🙌🙌🙌

Give up TN. file for expedited EAD due to job search and pray that USCIS does not furlough all its employees
