No she is not eligible unless you had her listed on your 2019 taxes.

No one can answer because it's a unique situation. Just request your expedite. Do you know if your embassy is open for expedites and emergencies?
Many people have been approved for expedites but Embassies still not open.

Our lawyer said I need to bring the medical exam results to the interview so I should reschedule the interview.

My medical exam is today (Thurs) and my interview is next Wednesday. I'm a bit reluctant to reschedule the interview.

 

On the other hand, my lawyer said I need to bring the I864 original to the interview, and ask my husband to pick up the original (signed by the lawyer as well) and FedEx to me.

 

I'm quite frustrated now. I was DQ in March but the lawyer didn't give any further info in the last few months on how to prepare until now.

I would call the embassy and explain that you won't have your medical results before your interview and ask if it would therefore be better to reschedule your interview. This happened to my wife, and they wanted to do the interview when it was originally scheduled. They just asked her to send in her medical results and vaccination info afterward. (Six days may be enough time to get them your medical exam results.)

I would suggest you get a new lawyer because he's causing you undue stress with terrible advice. Do not reschedule your interview unless you literally can't make it. At the interview explain you got the interview at short notice so the results of your medical are pending.This assumes the embassy won't even have your medical by the time of your interview. Your situation is not unique and the embassy simply delays adjudicating your case until they receive the medical results. 

 

As I've said before, you do not need the original i864. Take a copy of the signed form and supporting documentation to be cautious but the probability of being asked for them is negligible.

I'm at the doctor's office for medical exam now. A nurse here said they've seen many cases like mine now when the medical exam results would not be ready before the interview. She said she would give me a receipt of today's medical exam for me to go to the interview. The medical exam report is e-report and will be sent to the US Consulate here.

 

About DS-5540 -  I asked my lawyer if I don't have an insurance on hand, can I use my health insurance (worldwide coverage) here together with my assets to show I can cover my medical needs in the short term. Then she sent me a bunch of questions. It's a bit hard for me and my husband to gather everything for her to complete the form so that I can print and sign.

Thanks. It's helpful to hear your wife's experience. I planned to call the Consulate today after I did my medical exam. Let's see what they say.

We schedule a doctor's appointment, but won't be able to get the medical results in time. I assume, if things goes well during the interview - we will be getting a 221g card of temporary refusal until we provide the exams results? Please correct me if I'm wrong. 

 

Also, I was wondering - we applied for a CR1 visa. However, we will be hitting out 2 year anniversary soon. In that case, if we enter the US after our 2 year anniversary, will my husband be granted an IR1 instead? I'm aware we might need to bring it up to their attention, otherwise they may think this is still a CR1. Or does not not work that way anymore?

Depends, usually couple of days. But your case will remain at NVC until Interview was scheduled.

That’s not true for all embassies. I-864 usually is not required as original paper, I believe only some MENA countries require originals. NVC clearly states that they’re not requested anymore.

Reasons for AP are many - a missing document is usually not one of them. Once you provide the document, the consulate triggers the visa issuance process UNLESS there are other reasons for extended AP.

Yes, that’s correct (both, medical and IR1)

I am confused. You just stated you were sent in AP. Now you’re case is at NVC. Which one is it?
