Hello All,

okay let me see if I can get this correct, and if I do, please let me know.

My Fiance will be here July 20th on a K-1.( that much I know) :dance:

Once she gets here, can I apply for a social security card for her, i had heard wait maybe 2 weeks.Is that true?Or do i have to wait until we are married?

THen only after we are married I then apply for an adjustment of status, and advance parole if we want to travel, or can i apply for an advance partole as soon as she gets here?

Also what about working. Can she work or apply to a university once she has a social security number or does she have to wait until we are married?

And finally, what if she used had a social security # when she was here on a student J-1?

So there you go.

Any help would be great.

wow, we have already recieved our Biometrics appointments. It is only 2 1/2 weeks away.

It seems to be moving rather quickly.

No she can apply for a SS card without being married (sometimes it's easier this way). The reason some women wait is that they want to have their married name on their card if they change their names. It will just mean an extra trip to the SS office later, but not a big deal. You can wait until after she's married, but DO NOT MENTION that you're married. They have this insane belief that K1 visa holders cannot get a SSN after marriage even if the I94 isn't expired. You're right about 2 weeks after entry, though.

Advance parole can only be applied with AOS or after. It takes 70-90 days after NOA1 to receive.

Also what about working. Can she work or apply to a university once she has a social security number or does she have to wait until we are married?

If she enters through JFK airport in New York, she will get a temporary work authorization stamp which is only valid for 90 days (the same length of time as her I94). It is only given at this airport and she may need to ask for it. If you marry within a couple days after she comes here, send off AOS package immediately afterwards, she might get lucky and not have a gap between work. If her employer is nice enough, they may allow her to not work for however long it is (a week to a month depending on how fast you fill out the forms and they process it). If this is too stressful, she should wait until she has her EAD to apply.

And finally, what if she used had a social security # when she was here on a student J-1?

Then that is her SSN for life. She will not need to apply for a new one, so nevermind my answer to the first question (she may want to go in after marriage to change her name on her card if she's changing her name to yours).

Just remember that the fees go up after July 30th, so if you want to beat the fee increase, you'll have to be quick with all of this. Start filling out forms now.

SSN can be applied for 2 weeks after entry untill 75 days after entry on a K-1, after that you will need EAD or Green-card to apply. We waited until after marriage to get SSN with married name.

AP is an interim benefit of AOS, can only apply with or after applying for AOS.

K-1 is considered to be work authorized for the 90 days after entry, after that need either EAD or green-card to work.

As for College, that is a question to ask the school that you are thinking on attending.

If already have a SSN from having a student visa, then there is no need to apply for another one, a person has a number for life, K-1 holders will have a "Valid with DHS work auth" disclaimer on it until getting a green card.
