Hi all

I received an RFE for an incorrectly filed i693 effectively asking for another one. If this one were to be rejected and the AOS rejected then I'd be in the situation where I have a valid E visa, but my i94 expired (back a few weeks ago). 

 

What would happen in that situation? I'd need to leave the US and re-enter on my E visa and then work out my visa?

 

Realize this is all hypothetical, but my stress levels are all over the place, and Canada being closed for Covid19 doesn't help 🙂

Or refile the i485 again with the correct evidence

Since your I-94 has expired, you no longer have any valid status. You are remaining in the US lawfully while waiting for your I-485 to be approved. If you receive a denial, then you will become unlawfully present, which causes your E visa to be automatically cancelled. You would have to apply for a new E visa before you could return to the US.

 

Depending on which immigrant category you fall under, it may be possible for you to re-file the I-485 without leaving the US.
