The key is that the source of income needs to be US-based, and for most people, this is not possible if they move together.  A job offer does not suffice.  If the primary sponsor (USC petitioner) does not have a source of US-based income that will continue, they will need a qualified joint sponsor.

 

Since the OP stated that the petitioner is not current on federal tax returns, I would hazard a guess that they don't have a US-based income source.
