the I- 751 instruction said ANYONE other than the petitioner prepared the form must sign Part 10. My husband is not the petitioner. I am only the petitioner for this petition. I just followed what they instructed. My husband is not an attorney so I checked the box: "I am not an attorney...." in the Preparer's Statement section. And I must not include G-28 form with the I -751 form. If the preparer is an attorney then I would check the box: "I am an attorney...." in the  Preparer's Statement section and I must include G-28 form with the I -751 form. Check Part 10 on the I -751 form and the I- 751 instruction again and you will see.

Your husband is joint petitioner technically. You are filing jointly since you are still married. So he is not the preparer, he is also the joint petitioner. You should have filled his name in the joint filing section. You are the conditional resident, he is the petitioner.

Like @poh mentioned, you are quite lucky they let it go. preparer is someone who is official either the lawyer or the translator etc.

I think you are confused with the I 130 form. For I 751 form, the petitioner is only the conditional resident. Check your NOA letter for I 751 you will see who the petitioner is. Attached is my NOA letter, my name is in the petitioner field. Preparer is any person who just help me to fill out this form. It is simple as it has to be.

Yup. For I-751, the conditional resident is the "petitioner" that signs Part 7 and the US Citizen spouse is the "spouse" that signs Part 8: https://www.uscis.gov/sites/default/files/document/forms/i-751.pdf

No, I didn’t change my name neither submitted a request to change it after my application was received.

I found February filers who have the same update, saying name was updated although they never changed it. So that looks normal then, you're just ahead of us 😊

Thank you I am quite well aware of the difference between I-131 and I-751 that’s why I said technically. Joint filing is when you are filing when married to you spouse. You are not filing separately since you are not divorced.  Since your husband is also signing the form you don’t have to make him sign again for preparer. Preparer would be anyone other than the both of you who volunteers to fill the form for you. As simple as it is. 😊

There is no harm for the husband to be a preparer, in one of the pages it says I consent to bala bla where there’s a box just under that clarifies that May be not a lawyer or any accredited person so it can be anybody helping the non English speaker to fill out the paper it might as well be the husband.

I have done it before for the I130 and had no problem!!!!

I understand "Petitioner" differently than you do. USCIS does not consider the spouse of conditional resident as a petitioner since they call that person "Spouse", not "Co-petitioner" or something like that. Anyway it is fine if you leave the Preparer section blank. And they will assume the conditional resident filled out the form.

if so, USCIS have to says anyone other than "petitioner and the spouse" ....filled out the form must sign Preparer section. It would make more sense.

And just because you follow the rules to the letter doesn't mean they won't send you an RFE anyway. Just take it one step at a time 🙂

I’m sorry? I’m just saying they are very ambiguous in their instructions that’s it. I never said I followed rules and others didn’t. There is no reason to wish for RFEs for me. This forum is a place where we wish to alleviate our tensions not wish each other more problems. Appreciate it. 😊

I apologize as that must have come out the wrong way. That's not at all what I'm saying 🤗

By you I'm talking about the general you (English is a strange creature).

Back in Feb/March, USCIS started sending back forms because they were from Dec 2019 even though this form is the most updated one, despite filers doing their best to do everything right.

Thankfully they got the word around to the staff who were doing this now, because filers aren't getting their packets back for this anymore.

What I meant is that we should just take the application process one day at a time, and not worry so much, since even following everything to the letter doesn't guarantee we won't get an RFE ☺

I also liked your post because I agree with you, they are so ambiguous 😉
