Timeline

I'm on an L1 visa and my wife is on an L2. Our original i94s were to expire 12 of July 2020 as that was our initial 3 years. In January I went to the UK to renew my visa and I returned, my i94 now expires end of November 2021. We filed the i539 internally for my wife 4 months ago. Today we received the I-797C stating approval. However the dates are strange. The valid FROM data is in the future, 17th of December 2020. End date is the same as my expiry in November 2021.

 

So what exactly happens from Mid July to 17th of December? We are currently in the US.

 

We are both currently applying for AOS as well. We both have combined EAD/AP cards. The end date on those cards to 16th December 2020. So is this why the 539 is only valid from the 17th? Do we need to do anything to 'activate' this EAD/AP from Mid July? I don't fully understand the implications here 😕

L1-B & L2 to AOS (EB3 skilled)

Northern Virginia (DC Office)

22nd November 2019: NOA1 received

18th December 2019: Biometrics completed

23rd December 2019: Transferred to NBC

28th February 2020: Ready for interview

3rd March 2020: i-797C stating interview scheduled for April 7th

20th October 2020 - i-797C stating permanent residence approved (Welcome to the United States of America)

31st October 2020 - Both green cards in hand!

Error by them or me? Is this something easily fixed?

Most likely an error by them (I can't imagine what kind of error you could have made, to lead to this result).

 

Usually this kind of issue can be resolved by calling USCIS and asking them to send you a new approval notice with the correct date.

If you have an EAD/AP card based on your pending AOS, then it remains valid no matter whether or not you have a nonimmigrant status. It expires on the date printed on the card.

 

There is no such thing as "activating" the card. So long as the card is valid, you can use it for employment authorization and for parole into the US after travel abroad.

Thanks, I was a bit confused about the EAD/AP

 

I manged to get hold of my lawyer and she said something very similar. i.e. I'll be sending a copy of the notice to her to try and get the start date rectified.

 

Hopefully this all gets resolved quick!
