Good day VJ’s. I have question regarding filing N400. So my son is living outside the US and I’m not trying to apply for his citizenship or get him (yet). As I research for N400 list of evidence. Court order or letter from his Dad are part of evidences. Does it mean that even if I’m not applying for him yet I still need to provide those? We don’t have court order or child support order as it is unusual in my home country. Thank you VJs and I hope that people can help me with my question.

There's 2 portions to that question regarding children. 

One is that you have to list all your children. 

The next is you have to check the box on the ones you are applying for together with you. In that case, you won't check the box with your child's info and no supporting evidence would be needed.

Concerning the child support question, you will need evidence to say you support your child. This is a part of the good moral character requirement. I have a child that I was/still am in contact. Is there a divorce order or something saying that you have to pay support? Do you pay your child’s father support? If so, do you keep receipts? I did money transfers so I took all of them in case they wanted them. I also had an email from my child’s grandmother who has custody saying that I was up to date on support. When it came to the interview I took everything but was only asked for I think it was 3-6 months previous to interview of receipts for support. I also took the online agreement that I have with the grandmother. I took it all just in case. Hope this helps. PM me if you need assistance. Also please update your timeline.

On child support, note that part of the GMC guideline in the manual states that it needs to be provided even if there is no formal court order.  So some form of statement of bank transfers or similar would be useful in the case of you helping support him, or a notarized letter from his dad if dad has agreed to take full financial responsibility and doesn’t require you to pay anything. 
 

The instructions detail the kind of things you can show:

 

In addition, if you have dependent children living apart from you, bring evidence that you support each dependent child and that you have complied with child support obligations. Bring photocopies of the court or government order and evidence you have complied with the order if a court has ordered you to provide financial support for a spouse, ex-spouse, or children. Such evidence may include:
(1) Cancelled checks or money order receipts;
(2) A court or agency document showing child support payments;
(3) Evidence of wage garnishments; or
(4) A notarized letter from the parent or guardian who cares for your children.

Thank you for replying. I’m still gathering more information and waiting for my ROC adjudication before filing N400. I appreciate your response.

Me and the Dad were never married so no divorcée decree or child support agreement. I send money every month for Allowance, I pay half of his school tuition fee, and other extra curricular activities inside and outside the school. I still have those receipts. I communicate with the grandparents (his dad’s parents) regarding our son. I send money directly to the grandmother. Me and the dad don’t talk . I’m just not comfortable asking letter from him as I know that he’ll be arrogant and proud for me asking help from him. We didn’t have good relationship.

I do have receipts since I send him monthly allowance, pay school tuition fees and etc. Meaning, bank statements and receipts could be sufficient GMC evidence and don’t need a letter from his dad?

If you have evidence of support (and it sounds like you have plenty) that should be fine to meet the requirement.
