US travel during pandemic is best option or stay where I am?

Hello,

 

My spouse CR1 visa got approved in Mar 15th and now its coming closer to expire date. Her Visa is expiring in next 2 months. I contacted the US embassy in Nepal and they told that they have few charter flights from Nepal to US next week. We both are currently staying together in Nepal at our parents house. We are safe and sound here but because of her visa we want to go to US before visa expires. US embassy is closed since end of March and they not sure when they will open again. Considering all situation, we are thinking of traveling to US but scared of the virus at the same time. I am confused what to do? should I let visa expire and wait till virus get resolved or travel before visa expires? Any one have experience with charter flight how safe it will be? Please suggest what should I do as I am so confused.

There is absolutely no guarantee that it will be extended or reissued. I would recommend you do whatever is needed to travel. The risk level will depend on where exactly you are going in the US, the amount of exposure, the precautions you take, and your own health. Where I live, life is starting to go back to a new normal-masks, no large gatherings, avoiding indoor activities with groups and we have consistently decreasing cases and even fewer hospitalizations. Some states are spiking. However, I anticipate a resurge in Fall is likely due to the winter so I don't think delaying will make things any better on the COVID side of things and it will definitely put the visa status in jeopardy. All things to consider. You will know what is best for your family better than us.

As for your flight, the air filtration systems and precautions will lessen the risks. However, flights are less and so most are full these days so don't expect 6 ft of distance to be maintained.

If spouse is able to leave on the flight I suggest leave ASAP. 
Personally I have no idea why someone would let their visa expire. There are thousands of other people envious of your situation. Are you prepared to stay out of the country for another year? No one knows when the virus will “resolve” but I bet it’s definitely not happening anytime this year.

You can easily isolate yourself in the US to minimize your exposure.

To travel or not to travel is ultimately a personal choice that each individual should make for him/herself. 
 

Is there any reason why you feel that it would be unsafe to travel now? Are either of you immuno-compromised? Or do you have a lung condition? Assuming you are young and healthy, you are statistically more likely to die in a car crash than from this virus. 
 

If you delay travel, there is no guarantee that the embassy will re-issue the visa any time soon, if at all. They may well require you to complete the process all over again. No one knows.

Thank You for advice... My spouse is 26 and I am 30 .We both are healthy and do not have any disease. I will have mindset now to fly by next week to US.

We will be heading to Dallas, Texas. Fortunately! charter plane final destination is also Dallas so I don't have to take any domestic connecting flights. Thanks for advice. I have mindset now to fly by next week to US.

That is a huge positive as well. Just follow the guidelines - wear a mask, don’t touch your face, wash your hands for 20 seconds. Obviously I’m not in your situation but I have a feeling it will be much better to be back then having uncertainty of obtaining a new visa for your spouse.

Do you really want to add another stress of revalidating the visa? Get into a chartered flight and finish the journey my friend

I'd say go for it now and not rely on getting a new visa.

 

Just be sure to quarantine afterwards. While you are very likely fine given your ages and health status, take care around others.

Over? Sorry, but that's incorrect. You've got ROC still, and possibly naturalization if you want that...and if not, you're dealing with at least some US immigration the rest of your life (card renewal every 10 years) unless you decide to leave the US.

Then again if you want to ever petition for somebody else.

And there's always the possibility of immigration court if something goes awry (i.e. certain criminal offenses).

 

You're together. But it's not over.
