Appeals court rules funding for Trump border wall construction 'unlawful'

The executive branch "lacked independent constitutional authority to authorize the transfer of funds," the ruling said. "These funds were appropriated for other purposes, and the transfer amounted to 'drawing funds from the Treasury without authorization by statute and thus violating the Appropriations Clause.' Therefore, the transfer of funds here was unlawful."

Yawn , just another overturn waiting to happen for the 9th. I knew it had to be the 9th before I even looked.

 

Odd it appears the 9th overturned the supreme court( I technically know not) but it will be a slam dunk over turn . Kind of like a declaratory ruling

SCOTUS ought to slam this down ASAP, dismiss with prejudice. Shouldn't be surprised it was two Clinton appointees attempting to inject their own policy over the President, it's why the people filing this favored the 9th. The President is set to have almost 500 miles of wall by the end of the year after endless attempts like this to subvert policy the President unequivocally has the power to make. Wall is gonna happen.

  So the SCOTUS will rule that it is OK to violate the appropriations cause? Be careful what you wish for.

Yeah, and it looks like the other case was decided on a standing issue but not the substance. Because the plaintiffs didn't have standing, the stay was lifted. I could be wrong and I am happy to be corrected but has there even been a ruling on whether the administration has the right to do this rather than a ruling on who can challenge the administration?
