JULY 2020 K-1 NOA2 to NVC to EMBASSY

I'm aware of the processing time it takes for the NVC to receive your case from USCIS; but I'm wondering if anybody happens to know exactly what happens to your petition right after approval? Does USCIS send it off right away to the NVC or does it just sit in the office for (in this case on the historical timeline from USCIS to NVC) 40 days? I'm confused. Is that when they actually receive it or when USCIS sends it with the NVC subsequently receiving it? 🤪 if that makes sense? Hopefully it does. 

 

 

This is why there is a PDF, to answer the same questions others have had when they were at your stage of the process.

 

Once you receive your NOA2 your case file is being shipped to NVC. The timeline for receipt from USCIS at NVC is about 4 weeks, but we have found that "your mileage may vary" when it comes to timelines. Once NVC has your case it will assign a case number and mail you a copy another 2 week has passed. So, our answer is normally 5-6 weeks before you will have a case number. Records will then ship to the embassy, but that process stopped about 2 months ago so they sit at NVC till the embassies reopen and call for them to begin to ship again.

The NVC letter to us was received about less than 4 weeks after USCIS approval. So there was a delay in us actually knowing the case had reached NVC. So I think a lot happens behind the scenes before the sponsor/applicant is made aware although they tell you to allow 6 -8 weeks. Hope that helps.

Timeline

Quick question i did a search and i think i understand but i want to double check. for the i134 i make well over what is needed for the 125%. Do i still need to add personal property and life insurance stuff? i figured i dont need to add my 401k from what i read. The mortgage i figure ill add since it also has my address as proof. I assume that this is a pretty generic question to make sure you have enough. The I864 will be more in depth i assume? Just want to clarify. Thanks!

Your understanding of the I-134, Affidavit of Support is correct. Here is what I recommend as this is the max that you will need for the interview. I have not had anyone say this wasn't enough.

 

EVIDENCE OF SUPPORT: You must submit any evidence which will show that you and members of your family who will accompany you are not likely to become public charges while in the United States. Visa petitioner (US Citizen) will have to complete form I-134. If the petitioner does not qualify as a sponsor, a Joint-Sponsor should ALSO be presented (any US Citizen living in the US or Legal Permanent Resident), who will also have to complete form I-134. Both, the Sponsor (Petitioner) as well as the Joint-Sponsor, will have to present last year's income tax return transcripts. W2 form and proof of current and sustainable income (e.g. letter of employment on letterhead including salary and start date, most recent salary receipts, bank accounts, the value of properties, etc.). You may download the I-134 affidavit at https://www.uscis.gov/i-134


Get the IRS transcript in place of the actual 1040 here:

Sorry to jump onto this- my partner had been a student for 4 years, he started working as an intern the start of july and has a 4 year contract. He is over triple the amount required for the two of us but doesn't have any tax returns for the last 4 years. Should we get a co-sponsor? I keep hearing different advice.
