Affidavit of Support questions (merged)

Hello all, 

 

I'm the US Citizen spouse and I'm getting ready to get a sponsor for my Affidavit of Support. I'm at the NVC stage of petitioning my wife in the Philippines. 

 

I currently have 2 daughters who live with my ex-wife in the US and 1 daughter that lives with my current wife in the Philippines. That would be 3 children total. The daughter in the Philippines will be coming to the US with my wife. 

 

I just want to confirm with you guys exactly how much annual income will my sponsor need to show to meet the requirements? Thanks!

Timeline

Are the two daughters from your previous marriage minors (i.e. under 18)?  If so, they count in your household size regardless of the fact that they are not living with you; therefore, you household size is 5.  Refer to the most recent edition of the I-864P for the minimum qualifying threshold.

June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!

September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Yes they are under 18. Thanks, I'll check out the I-864P.

Must meet or exceed the 125% poverty guidelines of the I-864P for the total number of persons;   https://www.uscis.gov/i-864p

Hi all, 

 

Getting ready to get a joint sponsor and I do have a sort of rich uncle that may help me but he doesn't work and most likely I will need statements of his savings or income from rental properties. 

 

On the other hand I could try to find someone who meets the regular income level needed. What would be recommended you guys think? Thanks!

You're going to find that using a self employed landlord will require a lot of documentation.  Landlords commonly show little or no actual income on their tax returns, so documenting real estate equities is probably not something he's going to want to do.  If he has plenty of actual taxable income though, you can skip all the asset questions.

Facts are cheap...knowing how to use them is precious...

Hmm okay. So it's better to show a stream of income rather than assets. Thank you sir.

Yes, it is, but remember, there's a difference between "rental revenue" and actual income.  For the self Employed, "income" comes from the line of the 1040 labelled "Total Income" and is the taxable income after taking all business expenses, and in a landlord's case, "depreciation".  This is why landlords very often show little if any taxable income, no matter how well off they may be or how lavish a lifestyle.  That leaves them with declaring and documenting (proving) the equity in each piece of real property.  Most will not want to do that.

Yeah I can see what you mean. I doubt I want to go through the trouble of getting all that from him.

I just wanted to double check on the Affidavit of Support if question "23.a" ONLY refers to Federal income tax returns and does NOT also include a State tax return? Thanks!
