I have applied for I-130 for my spouse and two kids. So far USCIS has approved the petitions of my kids but my spouse’s petition is still pending @VSC. My immediate family is suggesting me to move forward with the cases of my kids at NVC stage for DQ. So they can have a slot in the que for visa interview with MTL consulate after being documentary qualified. And I can add my spouse case once it is approved by USCIS and later request for same date interview. 

 

First of all, I don’t think it is possible and somehow I am not convinced with this idea. I should wait for the approval of my spouse case so that I can proceed with all petitions simultaneously. Secondly I am not sure if MTL consulate would like to have interview with my 10 and 16 yrs old.  

 

Looking forward to your opinion.

That is exactly what I suggest.  You can wait for the last case to reach NVC, then pay fees and submit documents for all the cases.  Then, you can contact the consulate to sync the cases for an interview.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I just edited my post above.  I would wait until ALL cases reach NVC, then proceed with all cases simultaneously.

Do they usually schedule visa interview for children?

My kids are 10 & 16.

Yes........but the consulate can schedule them all together.  I would contact them once all cases are DQ'd.

NVC schedules initial interview so you want NVC to join the petitions as soon as they have all arrived and not wait for DQ

So i will wait for my spouse approval. 

Then paid fee, upload required documents and at the same time request NVC to join the petitions.

I am thinking to call USCIS on Monday and request them to consider my spouse petition if they can. I will stress the point of family unity and that we cannot proceed further even after receiving approvals of children’s petitions.

 

Should I involve my congressman/senator office to persuade them based on family unity?

I know that my spouse’s petition is still under normal processing time of VSC but I want to try every string I can pull without harming his petition.

You can request,  they won't consider it unless you do.  Involving a congressman is of no consequence because she is not outside normal processing nor have you requested expedition so nothing they can do to help

August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
