It appears you did not marry within 90 days. If that is correct he cannot apply based upon the K-1. You will need to include the I-130 along with everything else, and the fee for it of course.

They got married on May 29, just couldn't get the marriage certificate.

That part is confusing as the OP says they married in May but weren't able to record the marriage so they had to REDO it in June.

@maleecka What is the exact date of marriage on your certificate?

Note:  For the I-944, you will need to send official tax transcripts, not just tax returns& w-2's . You must order these from the IRS.

Most of the people can not get tax transcript due to COVID. How do you know that w2 and 1040 does not work

True. I cannot get transcripts because IRS still did not process my taxes so I am sending my tax return and W-2. I will explain it in additional information.

I hope it works

The word "redo" is a bit odd, yes. Here in Los Angeles it takes up to 8 weeks to have your marriage recorded, but it obviously doesn't change the date you actually got married. We had to wait 4 weeks for our marriage to be recorded, but our wedding date on the certificate is still the date we got married.

Not sure what "redo" means though. If it means getting married again because something went wrong the first time, you could be right about not being married within 90 days.

FYI,  Transcripts are online on the IRS website for every year. I didnt need to talk to the IRS.  Unless I filed differently then you, I'd assume everyone had it on the IRS website.

Yes they're on the IRS website but far from everyone can access them. To access them online you need an account. To create an account the website asks questions to verify your identification. Tons of immigrants can't be verified, and also many US citizens can't even be verified. So then you have to request USCIS to send you a code via mail that you use to create an account. That's not a possibility now during the pandemic as IRS don't do anything that has to do with papers. They won't send your transcripts via mail, and they won't send you the code to create an account.

I didn't verify my account by mail, i did it through my phone.

from irs website

You need a phone number or a verified address

We'll need one more way to verify your identity. The easiest way is to send a code to your phone by text message (SMS). Your phone must be a U.S.-based mobile phone number associated with your name.

You can also complete identity verification by receiving a letter in the mail. If you choose this method, you'll either need a U.S.-based phone number OR an iPhone, iPad, or Android device to complete registration.

And many phone numbers don't work if they're not registered in one way or another (ie associated with your name). Mine never worked, I had to get a code sent to my address by IRS. Luckily I did that two years ago so I can access my account just fine now during the pandemic too. But like I said, far from everyone can access their transcripts this way right now.

@maleeckaDid you send a copy of the marriage  certificate? Per your wording, you re-did the marriage ceremony on June 12th and sent your AOS the same day. Just curious

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

If OP did not get married within 90 days wouldn't he have lost his ability to adjust status? Without the OP clarifying the date of the marriage, not when the certificate/license was obtained, I think all anyone can do is shout out guesses.

He would have lost the ability to AOS based on the existing petition (the I-129F).

So an I-130 would also be needed. As the spouse of a USC, being out of status is not a bar to AOS.
