JAMAICAN EMBASSY CONFIRMED K1 VISAS WILL BE PROCESSED

Please read it as i see it differently for K1

Sec. 3.  Scope of Suspension and Limitation on Entry.  (a)  The suspension and limitation on entry pursuant to section 2 of this proclamation shall apply only to any alien who:

(i)    is outside the United States on the effective date of this proclamation;

(ii)   does not have a nonimmigrant visa that is valid on the effective date of this proclamation; and

 

 

(b)  The suspension and limitation on entry pursuant to section 2 of this proclamation shall not apply to:

(i)    any lawful permanent resident of the United States;

(ii)   any alien who is the spouse or child, as defined in section 101(b)(1) of the INA (8 U.S.C. 1101(b)(1)), of a United States citizen;

(iii)  any alien seeking to enter the United States to provide temporary labor or services essential to the United States food supply chain; and

(iv)   any alien whose entry would be in the national interest as determined by the Secretary of State, the Secretary of Homeland Security, or their respective designees.

 

So, i take it applications will continue to be processed but K1 will have to wait to come into the USA until the above is terminated

A fiancee is not a family member and section 3 II says the EO applys to anyone that does not have a nonimmigrant visa on the effective date .   k1 is nonimmigrant

Did you find it convenient to ignore Sec 2. Where the classes of the affected nonimmigrant visas were identified ?

 

Sec. 2.  Suspension and Limitation on Entry.  The entry into the United States of any alien seeking entry pursuant to any of the following nonimmigrant visas is hereby suspended and limited, subject to section 3 of this proclamation:

(a)  an H-1B or H-2B visa, and any alien accompanying or following to join such alien;

(b)  a J visa, to the extent the alien is participating in an intern, trainee, teacher, camp counselor, au pair, or summer work travel program, and any alien accompanying or following to join such alien; and

(c)  an L visa, and any alien accompanying or following to join such alien.

Hey guys. I know that all of the K1 family has been stressed beyond a doubt during this difficult time with covid and the presidential proclamation now extended. So good news for k1 visas is we are NOT apart of the ban/suspension and our interviews will be resume once the Embassy reopens. My wonderful wife to be emailed them and got this response (other persons got a similar response too so it’s not just us 😁😁😁). This should bring much needed relief to everyone.

You beat me as I got the same email today and I believe they will eventually resume K1 Visa processing... I'm thinking positive.

2. As long as the Embassy is going to facilitate our interviews, your interpretation of the proclamation is inconsequential. 

And it will be worldwide not solely Jamaica!!!!

I hope so.

Been in enough jobs where middle-management doesn't want to pick up the phone to ask Corporate any questions about policy, so they end up erring on the side of the more restrictive / prohibitive interpretation of a new policy rather than getting clarification. My guess is this happens in government too.

Did you ask if the processing is based on local conditions or if it's by order from DC? I get that it's suspended, but I'm curious if it's based on numbers or if they're suspended because they need the go-ahead from the government.

More and more consulates are beginning to confirm that k1 is not affected
