Hello, so I have some questions if somebody has a similar situation or any info on this:

 

I applied for my dad with the form I-130 back in october 2019.... in january 2020 he came to visit me with his tourist visa his intentions never was to stay actually he had a return ticket for may 2020, but was cancelled by american airlines because the airport in Colombia is Closed and will remain closed for long time due to COVID 19, so I was so stress out because I dont want dad to have any problems with immigration..... surprise on june 9 the I-130 was approved and was sent to NVC (national Visa center, which I already spoke with them and since dad is here i have go on their website and file a inquiry informing that he is here and I am going to do Adjustment of status).

 

When I saw his approved online I called USCIS and told them the situation that i mention before and they told e since he is here i can filed adjustment of status all i have to do is add a copy of the I-797 action of notice of his approved with the package of the Adjustment.

 

I just want to see if anybody has a similar situation, I am little bit worry because I dont want to get a denial because he came in a tourist visa because the intention never was to stay?

I have questions about the form I-485 if u can help me:

 

1. in page 3 they ask for current immigration status? that will be tourist or b2 temporary tourist ?

2. in part 2, page 3... two options applicant or derivate? dad will be applicant? 

3. part 2 page 3, Family based, for my dad should i choose the first box: Immediate relative ...parent of a US citizen..., form I-130 ?

4. we haven't receive the A number yet, shoud I put None or N/A or leave it blank?

5. in the last part where they ask for the interpreter and the prepare, Me the daughter I filed all the form and translate everything for him because he doesn't speak to much english... so can i put my name under interpreter and prepare ??

 

 

Form I-864

So I have to add the form I864 and here is my question: I always filed taxes with my husband and both incomes are enough to support my dad, just to make sure i have to filed I864 in my name and my husband has to filed I864A?

 

I really appreciate you taking the time to read, all this is so stressful and I need some help.
