My dad (LPR) petition me when I was under 21. Now I’m 23. I’m in nvc, as visa f2a current then we filed ds260 in march. CSPA also applied on me that time. I read many post that mean my age freeze on the day I filed my ds260. Is that true? And since the new proclamation is ban almost a year, then do u think it will effect my status f2A? Has anyone experience this or has any idea, TIA

but as for the other you a child coming on a F2

read the EO   b #2 

 

(b)  The suspension and limitation on entry pursuant to section 2 of this proclamation shall not apply to:

(i)    any lawful permanent resident of the United States;

(ii)   any alien who is the spouse or child, as defined in section 101(b)(1) of the INA (8 U.S.C. 1101(b)(1)), of a United States citizen;

you are exempt and can enter the US when a visa is granted by embassy

 

People need to read these EO's and know what they say

He is not exempt. He is not yet a LPR and he is not the spouse or child of a USC.

HOw can the father even apply if he is not one of these?   just wonder how the case got to the NVC stage?

curious more than anything as it is not really my buisness

I’m not sure if you don’t understand the exception, or the basis of the petition. For the exceptions, It doesn’t matter what the father is, it matters what the beneficiary is. The exceptions apply to those receiving the visa, or those attempting to enter the country, not the petitioner.

The basis of the F2A petition is child of a LPR. Child of a LPR does not fall under the exceptions, only child (or spouse) of USC.

Your visa issuance is subject to the ban so you will not be issued a visa till after that, however you will remain F2A.

So let’s say age locked at 18 will he be always be that age during the process and secondly  if his father gets his citizenship during the ban what will happen???

Age locked means, age locked.

 

if his father gets citizenship during the ban he can upgrade the petition from F2A to IR2, and that is not subject to the ban.

The Child who may age out is exempted from the proclamation

Sigh. He is not going to age out. His age is already locked under CSPA.This has been discussed above.
