I-485 Current Immigration Status??

Timeline

We're almost ready to submit documents for AOS finally. The I-94 has expired and so has the K1 visa. On the I-485, Part 1. Question 24. it asks:

 

"What is your current immigration status (if it has changed since your arrival)?"

 

What should we put? I've seen very conflicting information online about this. The example form on here leaves it blank, should we? Has our status changed?

Unless you previously changed it, it would be the status granted upon arrival

I don't know how someone would change it so I don't think we did. We are on a very typical K1 immigration path. Thanks for the response. So, if it is the same status granted upon arrival, we would leave it blank because it says "If it has changed since your arrival", correct?

You would know if you changed it because it is a formal process you would have initiated

If your i94 has expired, you are no longer in the status you were admitted under. In other words your status has changed.

 

Expired K1 would probably be the correct term.

 

 

Spouse:

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

Your status hasn’t changed so the question is not applicable to you. N/A

 

Instructions:

 3. Answer all questions fully and accurately. If a question does not apply to you (for example, if you have never been married and the question asks, “Provide the name of your current spouse”), type or print “N/A,” unless otherwise directed. If your answer to a question which requires a numeric response is zero or none (for example, “How many children do you have” or “How many times have you departed the United States”), type or print “None,” unless otherwise directed.

Thanks so much. I was really confused about this as the K1 visa and I-94 both expired so when I read about it online it says that the status would be considered "undocumented" but she came here legally through an airport and can still legally adjust from the K1, so is she undocumented? This is too stressful!

I’d imagine it wouldn’t change? I’m not sure but it’s just my guess.

No. You are a tourist. That will remain until your status is changed to LPR after AOS approval. Marrying does not change your immigration status.

It's kind of a redundant question on the form because they want us to send the i-94 and visa stamp etc port of entry , so all they need to do is the math lol

For sure. Thanks much! I think we still have a little bit of time ahead of us before the interview but hopefully it’ll all work out.
