Permium Processing

Good day everyone,

 

I have been reading the comments of many members sharing their stories and updates about the process, which is very helpful. I have also seem on the USCIS website that your are offering permium processing for some petition I want to know if they offer that service for the i130 petition form for my husband. can anyone tell me if it's available.

It’s very clear CR1 isn’t listed. Also, Nigeria isn’t issuing immigrant visas so it wouldn’t apply to you if it was.

Their not issuing visas due to the covid 19 pandemic but once they reopen it's back to business/issuing Visas?

 There has been a ban on immigrant visas for months now- nothing to do with Covid- were you not aware?!

Spouses of US citizens and children under 21 are exempt from the immigration ban.

No, premium processing is only available for certain petitions, namely employment ones with annual caps.

 

There's multiple EOs with different bans.

 

A spouse of a USC is exempt from the worldwide ban on IVs, and bans based on physical presence.

 

Nigerian citizens are subject to PP #9983 (https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/presidential-proclamation-archive/presidential-proclamation9645.html), which bans IVs on security + identity grounds. Spouse of a USC is not exempt.

A waiver is possible. Historically (only a few months) Nigerians have roughly a 50% waiver approval rate.

If you country of citizenship is Nigeria then immigrant visas are subject to a seperate ban.  A waiver is available that can be recommended by the consulate officier. 

 

But if this for the spouse of an LPR, then the most recent EO bans visas for family of LPRs.  You profile says F2A

No immigrant or diversity visas, except for Special Immigrants whose eligibility is based on having provided assistance to the United States Government.

Not from PP9983.

No immigrant visas mean no immigrant visas.  A consulate officer can recommend a waiver.  About 50 percent are given those waivers.   No numbers are given indication how many times a CO does not recommend a waiver.

 

You might want to update your profile to show that the "Filed for" is a CR1/IR1 not a F2A

No, he is not exempt from PP 9983, which bans IVs for all Nigerian citizens. See the links from the official sources above.

There is a ban on immigrant visas for Nigeria yes but spousal visas have been greatly waived up until March 2020 before the covid by the COs It is at their discretion. Someone posted the issuance rate of this category of visas from Nigeria some days back. Let's stop misinforming people,

claiming to be all knowing or blatantly trying to be cold with responses. Nigerians have a forum on here an it is up to date with any information you might need @Tjimba you can follow up and see stuff for yourself.
