Well, I finally assembled my I-751 package and mailed it to VSC yesterday (01/14/2008.)

No NOA or bio yet, obviously :)

My wife and I are in the process of removing conditions on her residency.

I'm expecting the NOA soon because the check we sent for payment has cleared the bank.

In our situation we cut the submission of the I-751 quite close to her green card expiration. Her card expired on 1/10/2008. The way the timing is working out, I expect that she was "out of status" for a few days. But I do have a USPS delivery confirmation of the application being received at VSC on 1/2/2008. All in all a little too close for total comfort.

I think it's the postmark (the date it was posted) that counts, not the date it was received.

Am I right? :unsure:

It looks like VSC is the only that takes over a month from biometrics to approval. VSC is taking over four months.

Anyone here know about derivatives? Do derivatives (children included in application) have separate biometrics appointment than the principal applicant? My wife, principal applicant, received the appointment and had the biometrics done this weekend. I asked the person there about my son and he said that my son will receive his own appointment. Is this true? Can anyone confirm? Thank you!

It looks like VSC is the only that takes over a month from biometrics to approval. VSC is taking over four months.

My son was included in my I-751 and he had his own biometrics appointment letter. In fact, his appointment was 1 day after mine :wacko: which made for two very long drives for me. Your son should have had his letter and appointment by now.

I've had an idea ....... what do you think? For the newbies, my case was transferred from NSC to CSC back in august, I did bios in September and at the time people were getting approved within two to three weeks after bios. People way after my date have been approved, but I haven't received an RFE or anything. I am convinced my file is missing in action - fallen down behind a desk or something.

The annoying thing is that the official processing date for CSC is JUne 18 and you can't even complain until they are way past your own date.

Anyway, when I applied I just sent copies of our tax returns. I am thinking of submitting official transcripts from the IRS to add to the evidence. If I send them, surely someone will have to seek out my file and then they might notice me! What do you think?

There's no harm in trying it annelizabeth! Just be sure to include a copy of your NOA so that they can link your additional evidence to your I-751 file.

We received the I-797 NOA for the application to remove conditions last week. It is interesting to note that the form has a "Receipt Date" and a "Notice Date". Fortunately the Receipt Date shows that they received it January 3, 2008 (before my wife's card expired on January 10th). The Notice Date is January 12, 2008. I guess that means she was never actually "out of status", although for a few days she had no I-797 letter to prove it.

It may be that the data of the application is the date you send it via the mail, if you can prove it with a postal receipt.

Glad to hear that you finally got the NOA. Although she would still have been ok because your postmark date is before her GC expired, it still makes one feel a lot better to have proof of continued legal status on hand. :)
