Current income based on annualizing your most recent check stub

I asked one of the lawyer and they gave me this response" NVC look at the last year income  on your tax return, last year income matter the most as compared to current income"  to meet the poverty guideline.

That lawyer is wrong for an employed person.  For self employed, yes.  Annualize your pay stub for your current income.  Of course, you'll also enter total income numbers from the last three tax returns.  They'll look at everything, but current income is most important.
