F2A seems to be out until 2021. What’s your move?

Hi all,

 

So according to the recent Presidential Proclamation on immigration (thanks a lot), F-2A visa category which is for a spouse or unmarried children of a Permanent Resident will not be processed at least by the end of 2020. And frankly, I don’t believe that even if Mr. Trump is out of the office in November, somebody new would rush to change things back to normal.

Dear fellows who are in the same boat as I,  just out of curiosity, what are you planning to do? Any thoughts?

 

I’ve been around other topics on that subject, but the majority of discussion is happening about K-1s.

Just for clarification, Presidents don't leave office the day after elections are held. Trump's first term of office doesn't end until January 20th, 2021......but I get your point......

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

There’s an AILA class action lawsuit on the cards, though my understanding is it seems to be aimed at those who would face permanent damage due to the ban (like an F2A child in danger of aging out, but not a spouse who would just have to wait longer). 
 

Other than watching that, and waiting, there’s not really much you can do.

The whole situation of F2A is ridiculous.

 

With the ban, our spouses and kids are stuck overseas indefinitely (the ban is lasting till December 31 AND even though PD is current now, whenever the ban is lifted likely the PD backlog will come back). 

 

Furthermore, filing of I1-30 shows immigrant intent. And this disqualifies beneficiaries from applying for some temporary visa (F1, etc) to enter US for family reunion.

 

This is just absurd and intentionally force families to separate indefinitely.

 

I guess there isn't a magical approach with US immigration so messed up, esp. for F2A category.

Agreed. 

I'm going to have to travel more often to see my husband. Granted, I wasn't expecting a response from USCIS until Dec, but that just means the wait time has further increased. At this rate, I might have to upgrade his petition to spouse of citizen, I might very well naturalize before he his PD is current :(

Both F1 and F2B are affected.

I have just thought about obtaining my citizenship even though it could take more than a year now ugh.

who knows if this is going to end December 31st.

this is what AILA has

  • An applicant for an immigrant visa as the child of a lawful permanent resident who is at risk of “aging-out” of his/her F2A preference category under the President’s April 22, 2020, immigrant visa ban;
  • Any other applicants for immigrant visas in any preference category at risk of losing his or her place in line for an immigrant visa or eligibility for an immigrant visa under the President’s April 22, 2020, immigrant visa ban

what about the second one? could that be for us that are waiting for interviews?

My understanding is that they are talking about people who “lose their place in line” (like an F2A child that will age out into F2B and add years on to the wait) or someone who will permanently lose eligibility (like a diversity visa applicant who loses their visa chance entirely if they do not get a visa by 30 September). I don’t think it applies to others who basically just have some months added but are not permanently adversely affected and are still keeping your place in the “same line”.  But you can email them for clarification.

I am in this category but I submitted our passports (my 14months old daughter and I) after our interview. I Was expecting our passports back with visa in it untill Covid19 happened. Not sure if visa has been issued. Lagos embassy
