Request for initial evidence I-864

Morning everyone, 

 

My wife and I recently submitted our I-485 with all the relevant forms including the I-944 with all the appropriate evidence.

 

We received a request for initial evidence this morning (attached) stating that they needed more evidence surrounding my wife's income. This has been a little bit confusing to me because we had no issues whatsoever through the K-1 Process. For reference, we submitted her tax returns and pay stubs with the I-485, as well as her bank statements that show she has over $30,000 saved.

 

I have a few questions if people who are in similar situations would be able to answer:

 

  • We're currently living with my wife's parents and sister due to me rushing over in the middle of the pandemic and me not currently working. We listed our household size as 2 on the I-864 as my wife is only financially supporting me. Everyone else in the house is self-dependant. Is that correct?
  • Based on the federal poverty guidelines of $21,550 for a household of 2, my wife makes in excess of $42,000 a year after tax. From others experiences, is this sufficient? 
  • A lot of the additional evidence they are requesting was already lodged but was mostly provided with the I-944. Could this be part of the problem?

Looks like the I 864 was incomplete and not signed and USC SS # listed  / just do what they ask and send this in

as far as supporting evidence ,  it is often misplaced when it is not labeled with case #,  both names and both DoB's 

put them on each and every paper you send in the upper right hand corner

every officer has an inbox full to the brim and more and documents may not be in the right order so your supporting documents may be in "no man's land"

if you sent 1040,  they need W2's and things listed

best way to send is IRS transcripts 

but wahatever,  just do as they require or your case will not move forward

Like the above poster indicated it looks like it wasn't completely signed. 

 

You stated

I will assume you did not submit this info with the I864 then, correct? You should have treated the I864 as a completely different application. Submit the documents required/needed for the I864 and then the documents required/needed for the I-944. If you did not do this; this could be part of the reason for the RFE.

 

Your RFE looks like an easy fix; Do you have a copy of the I-864? (If not- in the future make a second copy of ALL immigration docs) make sure you resubmit it signed and completely filled out and the most recent edition. Submit the financial documents requested in the letter. It is up to the CO to look at the totality of your circumstances to make a decision if you will become a public charge, but my opinion, not that it matters, is that your wife makes enough and has enough banked.

 

If you clarify that you did NOT submit the documents specifically with the I-864 then I really think this RFE is due to that.

Thanks for your thorough reply! You’re absolutely correct in the fact that the majority of the evidence was indeed sent with the I-944. We sent it all with that based on the fact that we didn’t want to double print the same documents, but from your perspective that it should be treated as a separate application I can totally see why we received it!
